Helo everyone,anyone can help me if what are the forms and evidence should i file for ROC?my 2 years GC will expire the end of this year so i am worried if iu can't get this done before my gc ends..my USC husband passed away last 2011,we just got married for only 3months and we dont have joint account or joint income tax return..I only have his death certificate.pls help and thank you.

First, I am sorry to hear about the passing of your husband. Next, the good news is that since you already have your 2-yr GC and should be working, there shouldn't be any problem(s) filing for ROC on your own. Just make sure you following the directions correctly, fill out the I-751 correctly, and you should not have any problem.

Sorry about the short above answer. Since you are/were married to a USC being a widow or even being divorced does not deny you the ability to apply for ROC. Just make sure you follow the directions correctly and provide all the required documentation/evidence and you should not have any problem(s) with the ROC process.

First of all, I am so sorry for your loss! However, don't let this immigration paperwork stress you. The thing is you can file as a "widow" of a US citizen.

You will need the same form, I-751, which I am attaching a link to. Secondly, try and include as much as evidence you can!

You will have to request a waiver in I-751, saying that my "Spouse is Deceased". Please attached a copy of the death certificate so your waiver would be approved. This is PART 2 of I-751, you will see it there.

Some of the dates in your post are a little confusing, but it doesnt really matter.

Youre going to file the 751 and check off the appropriate boxes for widow. It seems as if your husband passed away 3 months after you were married. Youre going to include with your form the death certificate and any evidence you have of things you had joint during the time you were living together.

Its going to be minimal since it was a short amount of time. Try to find what you can. Perhaps a lease? A copy of your ID showing the address. A joint bill. Medical/hospital records that would show the same address. Maybe something from the funeral home that lists you as his wife. (or a memorial card that refers to you as his 'loving wife') Include anything you have to show it was a legitimate relationship.

Because your evidence is minimal you may not be approved with out having to come in for an interview. If you do have to come in, its not a big deal. People with minimal supporting evidence get coded in the computer as such and have a higher odds of getting selected for interviews based on the workloads of the local office.

The more you submit the greater chance you have of them marking you as sufficient and not minimal- hence the greater chance you wont have to come in for the interview.

Thank you so much for the reply capri,you really have a good point about my situation..We don't have any joint bank account,lease or I.d's from my old address since i never got a chance to have it, due to his illness condition but then i only have his death certificate and some funeral cards that list me as his wife,yes i think some of my evidences are minimal and u might right that i will be having an interview soon...Thank you so much.

2 or 3 affidavits from relatives/ friends will help.

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

I would assume you have some record of your relationship before his death - emails, pictures, etc.? I'd send those as well, even if you sent them for AOS.
