Registering California civil wedding at Italian consulate

Hello!

I received a K1 visa from the Uk, as was living there at the time, but I'm italian. Got married with USC last november in California. I looked through the instructions on the Italian Consulate in San Francisco, CA (as Alaska is under that consulate) but they are not very clear to me.. I also sent an email a couple of months ago but they have never got back to me.

Is there any italian who managed to do a wedding transcription, if so, what did you submit to the italian consulate?

I still have to update my residence with AIRE since moving here from Scotland as I heard I need to wait for GC.

I've just sent all the paperwork to the Italian Consulate in Detroit, that required:

- Our marriage certificate (long form certified copy), with Apostille;

- The translation of the marriage cert in Italian (they might want it done by a certified translator at the Consulate in San Francisco, you should probably check with them);

- Copy of my passport;

- Copy of my husband's birth certificate;

- The form 'RICHIESTA DI TRASCRIZIONE DI CERTIFICATO DI MATRIMONIO', downloadable from their website.

I am not listed in the AIRE yet, so I requested our marriage to be registered in my 'Comune di residenza' in Italy. Not sure how you should fill out that part of the form.

Hope that helps. Are you sure you need to be a green card holder to register with AIRE?

- how do you know if it's the long form certified copy? Mine is the one I sent along with AOS. I read on the consulate website that it has to have the witness/es day of birth, but on mine there's only their names and residence..

- you think that copy of my husband's passport will be good instead of birth certificate?

- also, did you make just bio page copy or the whole passport?

Maybe I don't need to have the GC, but I wanted to be 100% sure and send the right documents for changing my residence with AIRE and registering the wedding, hence sent an email with a couple of questions since it seems it takes 6 months or more to process the above....

6 months? Seriously? Wow.

I think marriage certificates are different from state to state. I sent the same one I used for AOS. It has the full biographic info of bride and groom (parents/children included), the marriage info, and a statement about the info reported being a true and accurate copy of the information on file with the Clerk etc. It also has a golden seal. The state we got married in doesn't require witnesses, so no mention of them. Hopefully it works.

In Detroit they specifically requested my husband's birth certificate and asked for the 'first pages' of my passport (I sent the bio page+the page with my signature). I'd try to check again with SF if I were you, maybe these requirements are Consulate-specific.

Taken from the Italian Consulate in San Francisco:

"Per completare l'iscrizione all'AIRE procedere come segue:

Compilare in ogni sua parte il formulario di iscrizione/aggiornamento

Firmare e datare il modulo nell’apposito spazio

Allegare alla domanda fotocopia dei seguenti documenti:

1) PER I CITTADINI ITALIANI

- Passaporto italiano (pagine con dati personali, data di emissione e scadenza,

residenza, firma del titolare, eventuali rinnovi)

- Permanent Resident Card (Green Card) oppure Visto USA

(il visto turistico B1-B2 non e’ sufficiente per essere iscritti all’AIRE)

- Prova di residenza nella circoscrizione consolare:

patente di guida statunitense con attuale indirizzo oppure contratto di affitto

o di utenze (banca, telefono, TV etc.)"

I did ask in my email if a K1 visa was enough.. it might be that showing a copy of my NOA1 of the AOS is ok too, but they don't specify... and they obviously don't bother answering to emails. My uncle who lives in California has always been saying that they were not offering a great service.

In the 5 years I spent in the UK, the office in Edinburgh was amazing instead!

I went to look at the italian consulate in Detroit website, just to see if they were explaining the procedure better or if there were differences... did they tell you there is no need to be registered with AIRE? Cos on their website they say that anything to do with your "stato civile" cannot be changed unless you are registered with AIRE.

I wish there was one in Anchorage, AK .. I would go there to speak to someone directly....

where are you from, if you don't mind me asking :) ?

I emailed the Italian Consulate in Detroit stating I am not listed in the AIRE yet, and asked what I should do to have my marriage registered in Italy. They replied right away with the info I gave you. Maybe the website isn't updated?

I also spoke with a couple of people who work at the 'Anagrafe' of my Italian municipality of residence, and they both confirmed they need to receive the paperwork from a Consulate to be able to register a marriage. They said this is the procedure even people who get married on vacation and then go back to Italy have to follow, so I don't see why a Consulate should require you to be listed in the AIRE to do it.

If I were you, I'd try to call and email, and call, and email, and then do it all over again, until someone bothers replying. Good luck, keep me posted :)

Hope the pdf I sent helps. I think they listed everything you need on there, and reading that form it really does not seem you need to be in the AIRE to transmit your marriage cert to Italy through the Consulate.

I emailed Detroit, they told me to wait until I get the green card to apply for the AIRE.
