Judging by the reference to Kali, I am going to assume he or she is in the Itum Kalinsky area which is in the Chechen Republic.

Probably eligible to apply for the DV.

But not a U.

I've had very serious bsod, a system crush and been offline all this time..

It took me almost 20 hours to fix it in spite of that i'm gifted in IT.

I haven't seen anything like this for a long time. What a mess..

ru ? Russia ? yes? no ? if no, please spell out the entire country name (thanks in advance ? ! ? ! ! ! )

ru? What's ru?

yes ru is russia.. though personally i don't write it with the capital letter anymore.

Xeviera you misunderstood the "U Visa" . The criminal activity that violated U.S. law" is regarding crimes that occurred in territories and possessions of the U.S.

The U visa status certification has to state the individual are being helpful or was helpful with the authorities investigating or prosecuting criminal activity that occurred in USA or territories and possessions of United States.

That may be true, but you are confused about what the U visa is. You are taking snippets from the guidelines and applying them with out looking at what the U visa is and ignoring what everyone is trying to tell you- Thats not what the U-visa is.

In plain English: The U visa is when a crime is committed and the immigrant can be a witness for the prosecution. The immigrant does not have to be in the US to apply for the U visa. The crime could have occurred in the US or in a US territory.

So lets look at your situation. What is the "crime?" (you were victimized and tortured) Does the US have a right to prosecute the "offender?" (the foreign gov that did it) No. Because the "crime" did not occur in the US or in a US territory. Therefore you will not be a witness for the prosecution because there is no case- so no U visa.

Of course i wasn't completely sure, that's why i came here to ask you all about it.

So eventually it did appear U visa is not for me. Yeahhh, too good to be true anyway..

Nevertheless a week ago or so i sent an email to the USCIS, no reply so far.

you also said "There are illegal proceedings against me underway". If thats true, and they are currently underway- your main concern should be seeking immediate refugee now in any country that will accept you

Exactly. I'm trying to do my best at the moment. But i'm all alone here

against the prosecution government machine and there's not much help around..

One quick question - why from all countries available around Ru you did choose US ?

Haven't chosen yet, been looking for any opportunities atm..

I've been fascinated with English ever since i studied in EU in 2003.

I've been reading books and watching movies in English for about two years,

and see my future, if any, only in English speaking cultural environment.

I'm in the wrong place, probably that's why they hate me so much.

Judging by the reference to Kali, I am going to assume he or she is in the Itum Kalinsky area which is in the Chechen Republic.

The Long Story.

*the system*

Forensic psychiatry in Eastern Europe, and in particular in the former Soviet Union,

was closely and directly involved in the political abuse of psychiatry,

and in principle the very same Serbsky Institute for Forensic and General Psychiatry is still dominant in the NIS.

This means that it is more complex to work in these fields in the Russian Federation,

but at the same time there is great potential to bring about major changes

that will contribute to a more civil (-ized) society.

*massive attack*

In August 2012 the special police force unit in camouflage and stuff raided my apartment, knocked down my door,

handcuffed me and locked me up in a state psychiatric asylum.

*the shot*

On the second night i was given a shot of a strong neuroleptic substance - aminazin/thorazine/chlorpromazine.

Which has a high profile of neurotoxicity and de facto has been withdrawn from medical use in some most advanced EU countries

For publicly refusing to take an unknown pill they wanted me to take not explaining what was it.

The injection was given to me by force. I was resisting actively. Grinning they fixed me so i couldn't move.

Because of the duty nurse saw my file that the police had written for her(information security really sucks here)

Four big #### with a huge grins ready to do anything for her nurse fixed me so that i couldn't move..

And guess what? probably od'ed me

Because having walked down the hallway i collapsed unconscious right away and some other inmate brought me back to bed.

The shot was given without any apparent reason whatsoever, as punishment.

The injection was not prescribed to me by the shrinks and could not possibly have been prescribed to me.

Because the psychiatric forensic law explicitly forbids any medical intervention during the actual evaluation.

By doing so they had violated their own law.

More so the shot had rendered me unconscious right away and I collapsed in the hallway.

None of them paid any attention to that. Some other inmate brought me back to bed.

I couldn't move. My breathing was stopping all the time and during 10 hours i had to apply conscious effort

in order to sustain breathing, literally surviving.

My official complain which had been filed to the russian ministry of the healthcare about all of this

was left without any consecutive actions..hmmm not exactly.. they replyed that "they can do whatever they wish"..

*the trip*

The experience i had was simply terrible. I had collapsed unconscious in the hallway right away.

Some other inmate brought me back to bed. The soul thrown in a river of fire.

My breathing was stopping I could barely breathe and had to apply conscious effort all the time.

I came down full of fear of mental pain. I was scared of everything.

Fact is shrinks acted as a part of the government oppressive system.

They didn't care the much about the evaluation itself but instead all the time kept

asking me questions the prosecutor had written for them.

They too can't defend themselves against this criminal government.

That's always been like that here and still it it to the large extent.

I have had enough of this country so to speak.

Basically it was a trip in hell. I couldn't move, couldn't breathe normally

for about ten hours i had to apply conscious effort to breathe..

Like in a river of fire, the sea of fire i was thrown from the cliff.. Not me, my soul..

Came back full of fear of mental pain, of anything and anyone and lots of mental restrains..

I can describe this as defining the boundaries, pain perimeter limiters inside the psyche..

But they sort of shape the personality using the fear of mental pain.

I asked these shrinks later whether they ever tried the substance themselves..

It appeared none of them had any personal experience whatsoever and they give it to the others..

In short i told them that they are in violation of the first and the most important rule of any psychotherapy imaginable.

They had nothing to reply.. What the ###### do they think they do? Aren't they asleep either?

Sometimes i looked to these nurses and i was scared because the only difference i saw was that ones were

in special clothes for inmates the others were not. I mean they could really dig each other, i mean catch "the same wave"..

I quickly realized that the only way to get out of there was establishing a link with my personal shrink,

i had to because nobody else around cared about anything at all, there's no one to talk to and i was severely restricted from visits.

All inmates were on benzos, tranks or some other heavy ###### like neuroleptics.. All spaced out round o clock.. Food is simply awful..

Almost all except professional felons i met there - murders, rapist (i mean those who cross personal border of the other human being)

They seem to have special skill they use in such environment and are granted with small but still power over others by the med staff.

The same system of control was established in nazi camps..

Basically they wanted only my confession and treated me with that i could have stayed there much longer.

Meat farm, with living meat, enslaved masculine archetype, enslaved by feminine, i'd say sometimes witches.. This is definitely sick

People there have no human rights at all and are treated like living meat. ###### hell!

Some of them couldn't even reply to the question when they are going to be released..

The longer you are there the more federal money they would receive. This is ###### business i tell you..

So nobody comes out early. I spent a lunar month there and now i feel like having this ###### Ptsd

The experience itself was devastating to the psyche and caused a lot of mental pain and damage to me.

I came down full of mental pain and was scared of pretty much anything around me. Moral terror.

The shrinks didn't actually care that much about the evaluation itself.

Instead they kept asking me questions which had been prepared for them by the prosecutor in order to get my confession.

And threaten me all the time with that i could have stayed there much longer, virtually for years.

I consider being released so early is a miracle on its own after all that i'd seen there.

They can hold anyone there as long as they wish and there's nothing can be done from the inside.

Many inmates which i had encountered could not answer the simple question - when are they going to be released?

his is a psychiatric prison of some kind.

I asked those "doctors" if they had ever tried themselves this neuroleptic drug they gave to me.

It appeared none of them have had such experience.

That's just horrifying beyond any recognition to me. I study psychology in life.

The Californian Psychology school is my favorite..

And the first and the most important rule of any psychological health care is -

under any circumstances a doctor must never give to a patient any chemical substance that he have never tried himself.

I told that to them. And they didn't know what to answer..

The chemical agent they shoot to people is some kind of a vey potent neurotoxin..

There's more about it in the links above.

Spending a month in the psychiatric asylum they locked me into was no fun at all.

Schizophrenics, murderers, poor #### of all kind were side by side with me day and night.

Food quality was awful, all patients are slow and on benzos or neuroleptics all the time.

People there have no human rights at all and are treated like living meat. ###### hell..

The final official psychiatric report on me states that subject is highly intelligent

but no special psychiatric treatment is required whatsoever.

*the case*

In fact I have been officially charged by the government with receiving unopened international mail

I believe the prosecution is illegal.

That way anyone can be blackmailed, criminally prosecuted and locked up in an insane asylum in this country.

Actually at first they even messed up everything and charged me with another law provision

which implies minimal possible penalty 8y.

Only after my protest the charges were dropped and changed.

I've already been being prosecuted for about 10 month altogether and facing up to 2 years.

But the russian judicial system is way different from the US.

It has no law or advocacy institution, only awful statistics.

Justice? Even my attorneys do not believe in it. So should i?

Nobody really knows how much justice left here..

They want everybody here to live in constant fear of just about anything. many do live in fear indeed. somehow get used to it.

up to the point of living in fear of going to the p.o. for collecting the mail. this is no democracy or open society.

this is a totalitarian police state. russia is almost a totalitarian police state nowadays.

Considering all that i have already been through and seen first hand my case is clearly political here.

The russian government prosecutors hold no respect to my international background

or my social values of the open society whatsoever. The methods this corrupted russian government

and those who are in power apply are targeted to the annihilation of intellectual elite in their own country.

That's f civil war, no less.

I see through them and i can see their souls. What a lie they choose to live..

Lie is they major crime, they allowed to lie to anyone to get a confession..

And they have lived so long in this lie that can't see nothing else anymore..

Even to my prosecutors, who are hardcore nationalist, it is not a secret that i'm opposing the government.

The investigator, she hates my international educational background and values of the open society which i possess.

It's in the plain sight and obvious to anyone who can see.

*the night*

In March 2012 i was attacked by the police, they just grabbed me in the street,

had to spend a night at the deserted police station with those monsters.

I was beaten, tortured, abused and intimidated. They told me next time they'd kill me or shoot off my limbs and so on.

There were four of them. They had been drinking vodka all night long until they passed out in the early morning.

They were aware of my previous travels abroad and called me "the spy from the west" and other ####### like that treating me that way.

They tore down my lip (i have a scar) and almost broke my nose beside countless kicks and punches in the head, chest, kidney..

Next morning they brought me to the magistrate. All my clothes were covered in blood stains.

The magistrate didn't pay any attention at all and just said that he doesn't need me

so confused beyond any recognition they let me go. I was hysterical.

*the raid*

In April 2012 my apartment was raided in 2 a.m. in the morning. The police brought 2 witnesses with them.

That's again against the law which states "that witnesses must be found on the site in presence of everybody present and not in advance"

My pc, cell phone and even my wallet have been seized. I couldn't get my wallet and driving license back for 2 month without any explanation why.

They behaved themselves like f rednecks at my place, reading my love letters, insulting me and my family all the way.

*invaders must die*

In July 2012 they simply invaded my private apartment without any warrant. Just opened the door and came in.

There was even a witness of such outrageous infringement of the human rights.

My elder brother was at home in the other room and they didn't notice him while knocking my room's door.

The Illegal entry into the dwelling by the police without a warrant or an invitation is a felony with aggravating circumstances on its own!

Brought me by force to the court for a decision about my involuntary commitment. In reply to my complains about the illegal invasion into my apartment and bringing me to the court against my will

the judge only said that she "will consider that" and "i don't see anybody holding you here by force".

*the taste of it all*

For instance the investigator officer, what moral values does she hold, ###### up ones, how she behaved herself in my room..

What nationalists these people are? And they really do.. (personally i do not consider them ppl anymore, don't even talk to them)

i've heard that they were saying about me to my close relatives behind my back..

How feel how they want that everybody live in fear all their lives..

I mean how could this be? I don't get it. How can someone want to have the other fellow human in fear..

I know it's business but there's something more to it.. Some kind of a soul sickness?

No i do not hold rage for them anymore or i want to pretend it to be so

their just poor blind kids, still asleep in their minds and their hearts..

If only they could see what they are doing they would not do this. But they can't..

They bring so much pain and destruction to this plane of being even not aware

of that all the pain they breed will eventually be reversed upon them..

Strongly addicted exclusively to nicotine and alcohol.. Me? I used to be like them once, we all, don't we?

Nobody comes to this world fully awake, everybody have to figure it all out for themselves, это самсара детка..

Not anymore.. We've known too much..

*fear not*

Nowadays I live in constant fear of the police and it's oppressive system and cruel methods.

Almost primal animal fear you know. I've lost my faith in advocacy after all i'had already seen myself.

They can not even defend themselves properly against the police. Can they defend the defendant in this case?

In fact they are an integral part of the system to some extend and almost could not help me.

Most of them are former prosecutors themselves and i'd say to some extent they still are in the mind.

Yes i have an attorney but the point is all of them i managed to find

are former les and i would say they still are in their minds from my experience of interacting with them..

My attorney says only something about that court statistics, which is not that encouraging at all.

At the moment i see no other way how i could defend myself.

I have 9 international visas which have been issued to me during the last 10 years.

I've lived abroad before and had my studies in the university in the EU.

I still remember how things "slightly" different in Europe in contrast to what's happening here..

Especially how valuable human life and individuality and how little do live and freedom mean here..

I'd wish to film a documentary about all of this. That would be a really powerful story.

But right now i'm broke. The consequences of all what's happening are truly devastating.

Need legal protection of some other country, because this is no country to me anymore.

But i'm not sure how to apply, there's simply no one to talk to about this sort of thing.

So basically youre stating you were persecuted by the government for political opposition.

Heres some general info:

"People who are given asylum or refugee status are entitled to special legal protections under U.S. immigration laws. If you think you are eligible for these protections you will need to follow the requirements of the asylum or refugee status application process and prove your case to the U.S. government.

One key difference between applications for asylum or refugee status is where you apply -- refugees must apply from outside the United States, while people requesting asylum must apply either at a U.S. border (including airports, seaports, and the like) or from within the United States. Here is an overview of the application process for asylum or refugee status:

To apply for refugee status, you must find your way to a U.S. Embassy or Consulate or, preferably, to an office of the UN High Commissioner for Refugees (UNHCR). There, you will be asked to prepare and submit USCIS Form I-590 and other documents, including a promise by a U.S. sponsor (usually an organization) to support your resettlement efforts. But that's not all.

You'll be asked to provide proof of your persecution and a detailed affidavit explaining what happened and why you are afraid to return to your home country. The affidavit is particularly important and should spell out the details of what has happened to you and what you fear would happen if you returned. (It's not enough to say something general like, "I was persecuted." You'll also need to undergo a medical examination.

After submitting your application, you will meet with an overseas asylum officer who will make a decision on your case. If approved, you will be given a visa that you can use to enter the United States. If your application for refugee status is denied, there is no opportunity for appeal."

Heres some more about how to qualify:

"not everyone qualifies for asylum or refugee status. You must meet some strict requirements, as described in this article. In particular, you must show two things:

You are unable or unwilling to return to your home country because you have been persecuted there in the past or have a well-founded fear that you will be persecuted if you go back.

The reason you have been (or will be) persecuted is connected to one of five things: your race, religion, nationality, membership in a particular social group, or your political opinion.

Let's look more closely at what these requirements mean.

What Is Persecution?

Persecution means to harass, punish, injure, oppress, or otherwise cause someone to suffer physical or psychological harm.

U.S. immigration law does not list specific examples of the kinds of persecution that would qualify someone for asylum or refugee status. However, from the law that has been developed through court cases, we know that it can include such acts as threats, violence, torture, inappropriate imprisonment, or denial of basic human rights or freedoms.

Historically, for example, the need for asylum or refugee status has been recognized in situations where a foreign government has:

imprisoned and tortured political dissidents or supposed undesirables

fired on protesters

commited genocide against a certain race

made sure that members of a certain religion were left out of the political process,

and much more.

Even if a foreign government stands by while someone else commits acts of persecution -- for example, if the authorities are unwilling or unable to exercise control while members of a vigilante squad gang up on gays and lesbians or while members of a guerilla group threaten or kidnap people who won't voluntarily join them -- this too can qualify as persecution, which would support asylum or refugee status.

There is one type of persecution that is actually listed in the law: Being forced to undergo (or the fear of being forced to undergo) a program of "coercive population control." This specific protection is aimed at victims of the kind of forced abortion and sterilization that takes place in mainland China.

Just remember that the persecution must be connected to one of five grounds -- race, religion, nationality, membership in a social group, or political opinion -- discussed in more detail below. For example, violence directed against gays and lesbians is recognized as persecution connected to membership in a social group. But violence against an individual who happens to have angered a local criminal does not have the necessary connection to one of the five grounds, so a victim of that kind of persecution wouldn't be eligible for asylum or refugee status from the U.S. government.

In recent years, the U.S. government has recognized persecution based on gender (usually based on the "particular social group" category). This has allowed some women to gain asylum based on having undergone (or fearing they'll be forced to undergo) cultural practices such as female genital cutting, forced marriage, or domestic violence.

What Do the Five Grounds of Persecution Mean?

As mentioned above, the U.S. government won't grant asylum or refugee status to a person who has not suffered or does not fear persecution that's based on one of five grounds. The first three grounds -- race, religion, and nationality -- are fairly self explanatory. Let's look at the remaining two grounds -- political opinion and membership in a particular social group -- since they aren't as clear.

Political opinion. Persecution of this kind means that you hold opinions that the authorities don't tolerate, most likely opinions that are critical of the government's policies or methods. Of course, you would need to show that the authorities know about your opinions -- otherwise, they'd have no reason to persecute you. It will help if you have, for example, spoken in public, written about your criticisms, or taken part in anti-government protests. For example, people have proven persecution for political opinion based on having taken part in student demonstrations, been active in labor unions, advocated independence for a particular ethnic group, or joined an opposition political party.

You can also qualify for asylum or refugee status based on political opinion if the authorities mistakenly assume that you hold certain opinions, perhaps based on some other personal characteristic like your religion or family group. (This is called "imputed political opinion.")

Membership in a particular social group. This category is the most difficult of the five to define, and is the subject of many legal arguments. A social group is sometimes said to mean an identifiable group of people whose government views it as a threat. Or it is described as a group sharing a common characteristic that is so fundamental to their individual identities that the members cannot -- or should not be expected to -- change it.

Examples of particular social groups whose members have been accepted as asylees or refugees by the U.S. government include tribes or ethnic groups, social classes (such as educated elite), family members of dissidents, occupational groups, homosexuals, members or former members of the police or military (who may be targeted for assassination), and, in some cases, women.

If You Think You're Eligible for Asylum

Even if you think you're eligible for asylum or refugee protection in the United States -- that is, you've experienced persecution based on one of the five grounds -- you can still be barred from receiving asylum or refugee status."

--

"Asylum and refugee status are special legal protections under U.S. immigration law, available to people who have left their home country for their own safety and are afraid to return. But these protections aren't automatic; people seeking asylum or refugee status must apply for it and convince the U.S. government of their need. Some people simply won't be able to convince the government that they have a real fear of persecution. But then there are others who really have been persecuted -- or have a good reason to fear future persecution -- but must be denied asylum anyway under established U.S. law. People who will be barred from obtaining asylum or refugee status include those who:

have assisted in the persecution of others

are threats to U.S. safety or security, or

are already "firmly resettled" in another country."

Here is some additional information that might be useful:

Question:

I am considering fleeing my home country, because I’m part of a persecuted group here, and I want to apply for refugee status to come to the United States. A friend told me, however, that the refugee application process is lengthy and difficult. He suggested I instead book a flight with a layover in the U.S. and then request asylum at the airport. Would this route be easier for me?

Answer:

Neither route is easy. Refugee classification is a long process, but you will have access to plenty of support if you are eventually successful. Applying for asylum after you have arrived in the U.S. is somewhat easier, but you must have the financial means to come to the United States and you risk being sent back to your home country if you are denied.

To become an asylee or refugee, you must refuse to return to your country of origin due to a well-founded fear that you will be persecuted based on your race, religion, nationality, social group, or political opinion. In order to request refugee status, you must have left your home country (except in special circumstances such as a disaster or war); while to apply for asylum, you must be at the U.S. border or already present in the United States.

You cannot simply “apply” to become a refugee – you must first get a referral. A referral from the United Nations Refugee Agency (UNCHR) is your best bet for getting into the U.S. Resettlement Program (USRAP), but even then only 1% of cases are referred for resettlement in a third country such as the United States. If you are referred to USRAP, it is still not guaranteed that you will be given refugee status.

Next is the refugee application process, which can also be difficult. The good news is that after you are classified as a refugee, you will be matched with agencies that can give you support. Once you have arrived in the U.S., they will line you up with low-cost housing, employment options, access to English language classes, and a cultural orientation. Asylees do not receive all these benefits.

If you do not want to go through this lengthy refugee referral process, see whether you can obtain a valid tourist visa to enter the United States. That will allow you to wait until after you have passed U.S. Customs and Border Protection and entered the U.S. to apply for asylum, which you will be able to do by mail. You should submit your application within one year of your arrival (or ideally, before your tourist visa expires). In such a case, you must foot the bill for your travel to the U.S. and find your own place to stay, and perhaps pay a lawyer to assist you in preparing a persuasive, complete application. You will not be able to legally work in the U.S. for a long time after submitting your application. If you are approved, you can stay in the U.S., but if you are denied you will be placed into removal proceedings where you will have to present a convincing case in Immigration Court. At this point, the process can be overwhelming and time-consuming and will likely require the assistance of an experienced attorney.

If you cannot get a U.S. visa and you request asylum at an entry port during a layover like your friend suggested, you may be placed into detention. Conditions there are similar to prisons. You will have to wait around a day or two until you are scheduled for a “credible fear” hearing with an asylum officer. If the officer denies your request, you will be sent home immediately. If the officer decides that you indeed fear persecution, you will have less than a week to convince an immigration judge that you are actually eligible for asylum.

A bit out of date, implies that you do not need a visa for a layover.

Yes. Refugee is when you are outside (in another country). Asylum is when you are physically at the border or already within.

I dont know where you are- but it seems as if you should find the closest US Embassy or UNHCR location to apply for refugee status. Or find a way to a US border to apply for asylum.

(the refugee process does seem to be long, but there was mention on the USCIS page about expediting and one of the links referred to it- so if you are in immediate danger- ie your prosecution is pending and you will be sent back to be imprisoned and tortured due to your political beliefs, you may qualify for expediting- so you should immediately seek assistance)
