I-864 Affidavit of Support Question - Part 5 (21)

Hello Everyone,

I'm new to the site and have been reading a lot. I find this site to be very informative but I find the process a bit scary. I overstayed my visitor's visa in 2010 and Im now married to a USC and in the process of preparing my AOS package.

Here is my question:

On the I-864. Part B (21)

It adds the person being sponsored (Which is Myself)(1) My husband (1) His Spouse (Which is myself) (1) Any kids (1)

line H then asks to add these persons and this will be our household size. Which makes (4)

But our household size is 3. My husband me and our baby.

Any insight will be greatly appreciated. Thank you

Please read the question again. It says "Do not count anyone twice". For the purpose of immigration you are the immigrant, not his spouse.

It specifies to not county anyone more then once. In the first location there is already a #1, for the USC, the beneficiary is already counted in question 20 then just add the 1 for the child and you are done.

In preparation for the AOS process, I started filling out this form. Since it says not to count anyone twice, I didn't. In your case, you would enter 3.

The form is also used by people not sponsoring their own spouse, so I think that's where the problem is. They should have put under the spouse tab in smaller prints (If spouse is the one being sponsored, do not add twice to the total Household size.)

In the instructions for Form I-864, under Part 5 (page 6); it reads:

Make sure you do not count any individual more than once, since in some cases the same person could fit into two categories. For example, your spouse (whom you would enter on line 21c) might also be a lawful permanent resident whom you have already sponsored using Form I-864 (line 21f.) If you included your spouse on line 21c, do not include him or her again on line 21f.
