getting married in Germany

my friend ( US citizen) is engaged and wants to get married to his fiance ( she lives in Munich and is a German EU citizen) He went to the German Embassy ( two appointments) and they weren't helpful in answering his questions). Can anyone answer some of these or direct me to a site that can help him? Thanks!

1. Can I apply for the marriage visa from America?

2. How long (roughly) can I expect this process to take?

3. Can I travel between Germany & America while the visa is processing?

4. What part(s) of the filing or the visa process do I have to be present for in Germany?

5. When is my A1 level German language knowledge tested? At the interview?

6. What documents need to be notarized? Can I notorize them in America?

7. Translator at wedding? Translator for documents?

8. Health insurance for visa application?

9. 3 passport photos?

10. Can I apply for the marriage visa during my stay in Germany on the tourist visa?

11. I need a Affidavit swearing that I am not currently married to anyone else in America.

Where can I get this in the USA? How much does it cost?

12. Where else can I find reliable/easily accessible information regarding the marriage visa process?

1. The US citizen can file a spousal petition in the USA.

3. Yes can travel during the process.

4. He doesn't have to be in Germany for any part of the process. He can be there if he wants to but it is not required.

5. They shouldn't have a German language test. Its not part of the process.

8. don't need health insurance for the process.

9. More than 3 passport photos - those are in the instructions plus need some for the medical n stuff.

The other questions would be better answers from someone from Germany. They do have a regional forum for Germany on this website. It would probably be a lot easier for your friend to make an account and come on here and research and ask questions themselves.

1. Can I apply for the marriage visa from America? CR1/IR1 visas get issued in beneficiary country.

2. How long (roughly) can I expect this process to take? Up to a year...(it depends)

3. Can I travel between Germany & America while the visa is processing? Yes if on tourist visa or VWP.

4. What part(s) of the filing or the visa process do I have to be present for in Germany? See I-130 instructions.

5. When is my A1 level German language knowledge tested? At the interview? Language knowledge test at visa interview? Not sure of the import of your question.

6. What documents need to be notarized? Can I notorize them in America? USCIS require only photocopies of original documents at time if filing petition.

7. Translator at wedding? Translator for documents? All documents NOT in english (foreign language) need to be translated & certified. Not sure about translator at weeding.

8. Health insurance for visa application? Don't think so

9. 3 passport photos? Instructions tells you exact # of pp photos for petitioner and beneficiary.

10. Can I apply for the marriage visa during my stay in Germany on the tourist visa? If you doing DCF (Direct Consular Filing) and IF you meet the DCF requirements.

11. I need a Affidavit swearing that I am not currently married to anyone else in America.

Where can I get this in the USA? How much does it cost? Check your local county courthouse or website.

12. Where else can I find reliable/easily accessible information regarding the marriage visa process?

German embassy cannot answer your questions,you address the foreign representative of the country you want to immigrate to,in your case you have to contact the USA embassy in Germany or visit their website and see the guidelines pertaining immigrant visa and all FAQ.

And if they are planning to marry in Germany,they have to check with the appropriate body responsible for marriages * resident citizen and non citizen option.

A1 is only if you want to immigrate to Germany.i took that years ago.
