Yes and I completely understand that no one would believe me. I really do appreciate it though no matter how harsh, shows me the obvious impression given from my situation.

We had already planned all that which you suggest, so will go ahead and do that way. Filing I-130 today.

We're in Florida.

Florida... warmth... I miss that :P I'm in Iowa and there's snow on the ground again. Like living in a freezer :P

People are very emotional on this subject. Sometimes it helps to objectively read what you've written, to think logically about what it means as if it wasn't you and it was someone else doing something. But you're right that people do not need to be mean.

Phew, thank you for your honesty. I understand many of you find it hard to believe my situation, even I think it doesn't sound good!! A few of your posts made me cry because I know what's true to me and unfortunately I now see that no matter what I can't prove that. I will return to Australia as scheduled. People can stop saying I'm the kind of person abusing the system. NO, I'm not wanting to do that at all!!

Please don't think for a moment I don't know what it's like to be separated from spouse, have had plenty of long stretches of that. Please stop being so mean! I am a person too trying to figure everything out.

Don't cry over it! I believe you. Only someone who really had good intentions would do something that naive ;)! And I mean that in a good way. I did the same damn thing coming into Canada. I can share my story to make you feel better if you like ;)!

I think it's hilarious some people want to give you such a hard time. Legality is just legality. It's legal to do some things you shouldn't be able to, and illegal to do some things you should be able to. At least you and your husband are in a genuine relationship and wanting to immigrate for genuine reasons. That's more than I can say for some people. Marriages of convenience and such (my foolish father-in-law is in a horrid situation such as that).

I do agree it would be best not to risk AOS. You'd be putting more on the line than is worth, considering the consequences of it being denied, and that you don't have enough proof that immigration would listen to for your case. I can only imagine the despair you must feel at having to be separated by up to a year. But with immigration, it's important to try to keep your chin up and keep positive! Who knows, maybe you go back and you are approved in less than 6 months :).

The fact that you were admitted into the country by CBP shows that, to the satisfaction of CBP, you had no intent to AOS upon entry. It's not going to be an issue in my opinion. It's very rare that intent ever gets mentioned at an AOS interview based on marriage, let alone a denial for it. To retroactively claim that you had intent upon entry would also be a claim that CBP is incompetent.

Some of us advise the "safe" route because we have been through h-ll. Even doing it the right way a CO having a bad day can ruin your life for a long time. We went to our first interview with load of evidence, he knew names for my kid, my parents, my siblings, my grandkids and where they are living. He knew my college degrees and the company I work for. Daily phone calls and I had known his family for years. CO having some hormonal malfunction asked " If you want a visa I need to know what your fiance does at her ( classified) work. If you can't tell me details no visa " I would never wish that kind of trama on anyone. After another year we got the visa, and he has now applied for citizenship. With your issues on entry I wouldn't be suprised if you hit a snag AOSing in the US. Enjoy the fact you can travel freely. You have years together ahead of you

Don't cry over it. If you want an expert opinion before you choose what to do, find a very good lawyer and pay for the first appointment. Sometimes those appointments are free but make sure you do it person-to-person, not face to face. When my friend was trying to do the same thing, she contacted a lawyer that way and he gave them the advice to do what I suggested earlier. File I-130, wait for the processing in the home country, and visit often. It only took 8 months and they were truly apart for only 3 weeks during that time. Maybe she's lucky, but I don't think 3 weeks apart was that long...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
