Hello,

My fiance is Brazilian. He was here on a J visa until one year ago. He left the US, traveled abroad for several months, returned to Brazil for several months, and is currently traveling outside of Brazil again.

Our intention was to wait until he had been outside of the US for 2 years, then apply for the K visa. Now we have learned that it might not be that simple, if he has not spent a full 24 months in Brazil, even if he has spent that much time outside of the US.

My question is this: what proof is needed to show how much time has been spent in the home country to fulfill this two-year requirement? Will he need to provide bills or some proof like that? Or is the information in the computer system whenever he enters and exists the country?

I'm now considering going to stay with him in Brazil for the rest of the 2 years, but I want to make sure that we are keeping the proper documents and are not wasting our time with this sort of approach. Any other ideas or suggestions are welcome!
