Hello guys,

I have a dilemma here, I hope you guys can help me.

1. I will be filing our I-751 in the next month or so (as my green card expires in June 2013). My green card, passport and our marriage certificate are in my old name from my 1st marriage (annulled in the Philippines) however all of my US identification (SSN, state ID, pay stubs, mortgage, bank statements etc.) show my married name.

2. Which name should I put in Part 1 if I'd like my green card (permanent resident) to be under my married name going forward? Is there an additional form I'll need or fee I'll need to pay? Will it just complicate the USCIS if I change my old name to the new married name?

3. I have 3 kids on my 1st marriage. So will I just include them on Part 5 of the I-751 form? Will there be an additional forms to be attached with it? Will my boys required to have ROC too?

4. My husband and I were thinking of filing I-751 ourselves instead of hiring our lawyer who worked with us during the green card process. Will it be ok to do it ourselves or better use our lawyer in ROC? Will there be a chance that we will be denied or RFE in getting permanent resident cards if we do it ourselves?

Here are the evidences we will be sending to the USCIS:

-- Copies of Joint Income Tax Return (We have been filing jointly for 2 years now and will do it soon for 2012.)

-- State ID's/Driver's License

-- Joint savings and chicking account

-- Real Property deeds (We bought a house in August 2012 and it's both under our names.)

-- Insurance plans, we both are beneficiaries in each others health and life insurance plans.

-- Copies of photographs taken at our wedding, parties and events throughout our married life

-- Affidavits from friends and relatives attesting to the couple's marriage relationship (Thinking of letting my mother-in-law and my best friend write this for us.) Will this really help?

Apply using your married name and list the existing name as a AKA. List all children as directed on the forms and directions. See the others threads on the children issue. Why would you need to spend money on an attorney? Only if you can figure out what you need to do, in my opinion.

Thanks guys! So I don't need to lawyer up on this one? I'm just plain scared of getting RFE or denial. Though our marriage is 100% real, that's for sure. Any other docs I need to add among the list I posted above?

copy of your greencard, front and back. any bills in either in both of your names or any bills that goes to the same address even if one bill is under your name and other bill is in your spouse's name. any mail that has your name and any mail under your spouse's name going to same address.
