As K1 immigrant you possess legal status so K1's should not be getting pink striped licenses. If they enter through JFK they might even be given a temporary right to work stamp on their passport like my wife did and be able to start working immediately after entry.

The stamp is not valid for work, and has not been for several years. They still occasionally give out the stamp, but it's not legal for work as it's not listed on the I-9. 2007 and my fiance got the stamp so I suppose a lot can change in almost six years.

They still sometimes hand them out, doesn't mean it's legal to use it. A lot of people fall into that trap.

how can they be mad about a pink stripe - at least they are issued a license which is more than someone who is here legally on a K1 visa can get - at least in the state of MO - they will not issue until EAD - my hubby would have been happy with any color stripe - as long as he could drive

Absolutely appalling all the time and attention the illegals get from the government - but those of us who are going about it the legal way sit and what while our file is in limbo waiting to be processed.

Not true.

The I-9 still lists the temporary I-551 stamp in a foreign passport as sufficient to meet the conditions for List "A", Documents That Establish Both Identity and Employment Authorization.

If you get the stamp, you can work.

The I-9 still lists the temporary I-551 stamp in a foreign passport as sufficient to meet the conditions for List "A", Documents That Establish Both Identity and Employment Authorization.

If you get the stamp, you can work.

The I-551 stamp is a GREENCARD stamp. The EAD is not a greencard. The I-551 stamp is ONLY issued to immigrants, a K1 is not an immigrant. The EAD stamp we are referring to is entirely different.

You will note the stamp says "lawful admission for permanent residence" and "processed for I-551". These are for the greencard.

No you're not. You are NOT legal to work without the EAD itself unless you have an I-551 stamp (from an immigrant visa arrival, which the K1 is NOT, and the K1 is what we're talking about). Don't advise people to work without authorisation, it's against the VJ TOS to advise people to commit fraud.

I believe there have been a few cases here, where folks have been able to get the stamps from their local office by making an info-pass appointment.

Yes GREENCARD stamp. ENTIRELY different kettle of fish. Seriously, if you don't know what you're talking about, which clearly you don't, stop giving advice on the subject. You're wrong. You can hurt someone and their status with such advice. If they're working before marriage and caught they're deportable. Technically even if caught during AOS (and before GC approval where illegal work is forgiven) as it's illegal.

A K1 is NOT work authorised without an EAD card or greencard.

I-551 stamp is a permanent resident stamp. The USCIS designation for a greencard is actually I-551.

Work authorization is something entirely different. I seriously doubt that any POE including JFK was putting an I-551 stamp in any K-1 visa arrival's passport at any time. Maybe there's an I-765 (EAD) stamp. Not sure.

Because you certainly seem to be playing one here.

You don't need to be an immigration lawyer to know the basic information about a K1... that is: A K1 is a non-immigrant visa and they NEVER get an I-551 stamp at the border. An I-551 stamp and EAD stamp are two ENTIRELY different things. A K1 is NOT work authorised without an EAD (and later greencard). The EAD stamp, though occasionally still given out, is not valid for the I-9 and thus ineligible for work.

Yes, although I have heard some employers have issues with it since they want to see an actual green card. In my wife's case the green card showed up at our address ~1 month after POE with no additional forms filed with USCIS. Also, everyone that arrives on an IR-1/CR-1 visa get's an I-551 stamp regardless of POE.

We were offered the stamp at our AOS interview, after the IO punched a dozen holes in her EAD. We declined, not expecting to need it. It took about three weeks to get her card in the mail.

My wife got the stamp and a job prior to getting her green card. USCIS was aware she was working when we interviewed. If you can get the stamp you can indeed work.
