Plus it says:

"Failure to Pay

You will not receive a green card until the required USCIS Immigrant fee is paid.

Failure to pay does not affect your lawful status. You will have your passport stamped showing your lawful admission and permanent resident status. This stamp is valid for one year but it is strongly advised that you pay the immigrant fee as soon as possible to avoid delays in receiving your Permanent Resident Card."

As a K-1, you would NOT receive a green card automatically anyway, even after getting married. You will have to apply for AOS and there's a fee for that.

But as said, call the DOS to be sure. I guess they made a mistake at the embassy by sending you that in your visa package.

Alright, called DOS and they said K1 DOES NOT pay the new Immigrant Fee...so thanks to the embassy once again for making me wonder and worry by sending me tht lovely note saying to pay it. (They did something similar at the interview and I worried for an hour that something was missing until the next person said, oh yeah you don't actually need that for K1...grrr)

Anyway....flights are full this weekend so I am leaving monday! YAY

I just sent my I-129F at the end of January, but i remember the woman who helped me file everything, said we would have to pay a Non-immigrante visa fee, that would be when we have our interview...i think she said it was $100, and i could pay it online. It must be that...but now its $165!??

No, that's a different fee, and as said, that new immigrant fee doesn't seem applicable to K-1.

OP already paid the one payable at the consulate stage, which is the visa fee. Each consulate establish their own way of paying the visa fee, and the amount is often different. Sounds like in your country, that visa fee is $240 (http://www.visajourney.com/consulates/index.php?ctry=Mexico&cty=Juarez), but members from Mexico should know better than me.

Hey everybody!!

We made it through the K1 process all the way to the Visa, which came in the Mail today! YAY

BUT I am a little confused about a few things. First of I didn't know we had to pay another $165 Dollars before I leave to go to the states? I was going to leave right away (like tomorrow) but can I do that the day after I wired the money? And I am so confused that I haven't heard about it before, since I feel like I read soooo much and just abou everybodys posts.

Then, theres the big sealed envelope with the cut of edge and the smallsealed one and the note that came with it says to give one sealed envelope and the enclosed letter?? There's no letter enclosed, onle the note saying what to do and the note saying to pay $165. Please tell me I ain't missing something... :-(

And last but not least...custom form! What do I write on the custom form? Obviously everything I have in my bags is staying with me in the US when I fly over for good...but there's only 6 lines and I have 2 bags with all sorts of things. Did y'all write every item on there or just a general sum?

Hi, my hubby received his visa today,and plans are in order for him to travel tomorrow. we were just talking about the new $165 fee, from what i understand on the USCIS site, it is strongly recommended that the fee be paid before travel, however, it can be paid thereafter, BUT it must be paid before the visa in the passport expires. Please see below from the USCIS site.The visa will not be issued until this fee is paid!

USCIS Immigrant Fee

The USCIS Immigrant Fee is now in effect.

Any individual who on or after February 1, 2013 receives an immigrant visa package from a United States consulate or embassy abroad (including Canada and Mexico) must pay the USCIS Immigrant Fee.

Children who enter the United States under either the Orphan or Hague adoption programs, Iraqi and Afghan special immigrants, returning residents (SB-1s), and those issued K visas are the only immigrant visa cases exempt from paying the new fee.

When and How to Pay the Fee

Submit your payment after receiving your visa package from DOS and before you depart for the United States.

Pay your USCIS Immigrant Fee online. You will need to complete the electronic form and provide your:

checking account information, or

debit or credit card information.

All check payments must be drawn on a U.S. bank.

If you are unable to make this payment, another person can make this payment on your behalf.

For questions or technical help paying your fee, please visit the Pay.gov Customer Service website.

Foreign nationals who seek permanent residence in the United States and receive an immigrant visa will need to pay a USCIS Immigrant Fee beginning February 1, 2013.

USCIS has worked closely with the Department of State (DOS) to implement the new fee which allows USCIS to recover the cost of processing that is performed in the United States after immigrant visa holders receive their visa packages from DOS and are admitted to the United States.

Applicants will now have to pay both the DOS visa application processing fee and the USCIS Immigrant Fee.

What the Fee Covers

To me, that clearly states you do NOT have to pay the fee. You have a K visa therefore you are exempt.

I agree, or they would have bill you prior to the visa.

Please pay more attention to the OP's situation because:

- she applied for a Fiancé visa, which is a non-immigrant visa, as contrary as your husband's spouse (immigrant) visa (I guess because you're mentioning your "hubby"?)

- she already paid the visa fee (which is different than the New Immigrant fee), and received her visa

- what you copied and pasted from the USCIS website has already been mentioned by the OP herself.

- she got her answer by calling the DOS.

If you are speaking of you fiancé (not husband) and he has a K-1 visa: no need to pay the fee, but call DOS to make sure.

If you are speaking of your husband, and he has a CR1 visa, you guys probably need to pay the fee. If you have any doubt about that, please call DOS to make sure.
