From K1 submission to US Citizenship- 2 years, 1 month and 2 days!

K-1 Process
• 6 MAR 2012 - I-129F packet sent via FedEx overnight •

• 7 MAR 2012 - Packet received Dallas, Texas
• 12 MAR 2012 - NOA1 (Notice by Email: routed to the CSC)
• 15 MAR 2012 - NOA1 (received Official Receipt Notice (Form I-797))
• 12 JUN 2012 - NOA2 (Notice by text message and Email)
• 23 MAR 2012 - NVC received/forwarded approved I-129F
• 25 April 2012 - Interview and Visa Approved!
• 27 APR 2012 - Collected Visa at Embassy
• 29 MAY 2012 - Arrival in US after two weeks holiday together!
*It took 46 days from NOA1 to Visa pick-up and we received our NOA2 two weeks AFTER her arrival in States!

AOS Process
• 13 JUL 2012 - I-485 packet received at USCIS
• 23 JUL 2012 - NOA I-797C received for I-485 and I-765 (we didn't do an AP)
• 10 AUG 2012 - RFE for Proof of Employment and Fed. Poverty Level/Support Requirement!(Active Duty Military but deployed last year with little taxable income to report)

• 16 AUG 2012 - USCIS received my RFE document response & Biometrics completed on same day
• 21 SEP 2012 - EAD Received after a total of 6 USCIS Status updates
• 8 MAR 2013 - USCIS received our AP I-131 Travel Doc that we didn't apply for initially (bad decision)
• 26 MAR 2013 - Email Notice that AP was approved
• 03 APR 2013 - Card in hand! (9+ months from application to receipt of card)

Removal of Conditions

• Skipped with Military expedite

Citizenship N400

• 20 JAN 2014 - Packet mailed

• 02 FEB 2014 - walk-in Bio appointment

• 24 MAR 2014 - Interview

• 08 APR 2014 - Oath Ceremony

so sorry to hear, same thing happened to me, my wife left within a month of getting her GC. I have not filed for divorce yet, the advantage I have is that she went back to Mexico and is not living in the US. I'm in the process of writing a letter to ICE of her abandonment and not fulfilling her permanent residency requirements.

Just move on, it sucks but like everyone says Karma is a B****.

Not sure you have a leg to stand on there - as long as you are not divorced and she hasnt been out of the US for more than 6 months, she is free to do as she pleases.

[*] 15 May 2013 - Moved from MN to LA; [*] 17 May 2013 - Applied for a new SS card/filed an AR-11 online (unsuccessfully), therefore called and spoke to a Tier 2 and changed the address; [*] 22 May 2013 - Address updated on My Case Status (finally can see the case numbers online); [*] 28 May 2013 - Letter received in the mail confirming the change of address; [*] 31 July 2013 - Went to Romania; [*] 12 September 2013 - returned to the US using the AP, POE Houston, everything went smoothly; [*] 20 September 2013 - Spoke to a Tier2 and put in a service request; [*] 23 September 2013 - Got "Possible Interview Waiver" letter (originally sent on August, 29th to my old address, returned and re-routed to my current address); [*] 1 October 2013 - Started a new job.

correct, I plan on filing for divorce this year, I'm still recovering financially from the cost of the entire AOS process.

Her 6 months out of the country is coming up fast plus she is working in mexico as well and has enrolled her two children in Mexican public school, this seems convincing evidence she does not plan to establish residence in the US, I think?

Actually she doesn't lose her GC until she's been out 12 or more months. Trips outside the US of 6 months or more CAN be held against you, but 12 months is automatic. Even then she technically has to go before a US immigration judge to have it taken off her (so they say).

So, she could try and maintain her status for a while, you will never truly know.

Her kids being in public school doesn't mean SHE isn't going to live in the US, perhaps just over the border from Mexico, and work in the US to support her kids. It's not unheard of.

But as you said I will never know, I will simply inform ICE that she abandoned our home 5 weeks after receiving her CGC, and is not living in the USA. They can investigate or do nothing I really don't care, Once we are divorced she will need to file a waiver with ROC form, there will be no proof of a bonifide marriage since she left right after receiving her CGC.

Just take it one day at a time, it took me 6 months just to begin to write the letter to ICE, I probably would not have even written the letter if it wasn't for the support of a few good friends and reading the posts of other people on VJ who are going thru similar situations.

You may be found to have abandoned your permanent resident status if you:

  • Remain outside of the United States for more than 1 year without obtaining a reentry permit or returning resident visa. However, in determining whether your status has been abandoned, any length of absence from the United States may be considered, even if less than 1 year
  • Remain outside of the United States for more than 2 years after issuance of a reentry permit without obtaining a returning resident visa. However, in determining whether your status has been abandoned any length of absence from the United States may be considered, even if less than 1 year
  • Fail to file income tax returns while living outside of the United States for any period
  • Declare yourself a “nonimmigrant” on your tax returns

You married a brat, and she is nuts. You should apologize to your child for what she went through. Your child should always come first!

As soon your wife is homeless she will try to come back again.Do not answer her emails,phone calls. File for divorce or annulment and move on.Hug your child today like there is no tomorrow.

Right on the money...RUB women gone wrong are the worst. Others are not even close in the intensity of ####### they can pile on you. I know this is a generalization but they seem to be either extremely good or extremely bad. Sorry you had to find out the hard way. Good luck...

The more I think about the events at that hearing, I know the question of how are you was before we were sworn in. It was a gesture of politeness, not an official question. She told us when she started the official questions. So, as I said before, I was never asked about the marriage. We were asked some questions about her background. Standard ones like have you been a hooker, drug dealer, or arrested. Then a request for documents and some questions about where and when we were married. I was planning on discussing the counseling, but it was never brought up. I didn't lie, I just didn't offer it. How awkward would that have been? Oh, BTW she is a crazy ######? I don't think so. If they cared, they needed to ask.

Whether or not you said "fine" under oath or not is immaterial. The fact you came to the interview to support her application is where you messed up. You should have never gone since things were obviously not fine. But we all do dumb things that we regret later.

I agree with the others. File for divorce and cut off all contact with this GC scammer. And do not agree to meet her person under any circumstances if she manages to contact you. I don't think there's too much you can do to prevent her from staying in the US (legally). Like you said, CIS and ICE don't care. They are a bunch of lazy POS's who just want to get through the day doing as little work as possible. Forget the whole situation and move on. You can recover from this; money can be made back.

It still amazes me what people call a lie. You love someone, have a problem and then go to an interview and say yes everything is ok. Suddenly most of you jump on this bandwaggon and say I'm a liar. I don't know what planet you live on, but here on earth couples have issues, they work on them and move forward. I wasn't going to say to USCIS, well, we had this disagreement or that one. No, it's part of having a relationship, so get off the high horse and come to reality. Besides if you read the USCIS website, even they accept couples going through problems. There was no reason to say the marriage was troubled. It wasn't at that level then.

OK, now, is a different story. She filed DV on me, Lost! Filed for divorce, I returned with nullity. She will lose because I received her emails for some reason. We think she lost her mind, but for whatever reason she forwarded hundreds of emails with her telling her friend she didn't want to marry me but couldn't go home and other emails talking to other men telling them as soon as she gets her green card she is leaving me and then divorcing me after 2 years. Pretty cool, already got the support suspended pending the evidence hearing, after that I should be nullified. Bye bye ....enjoy that flight home and your lifetime ban to the United States of America! LIe to me and screw me over...ha ha ha..I think not!

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
