Hello VJ members! My petition for mom was approved after I filed in September and received the NOA2 somewhere last week of January. the NOA2 was dated Jan 22. Today I tried calling the 603-334-0700 to inquire about the case #. I was told that they received the document feb 6 and will take few more days to generate case #.

Now my question is, while waiting for that case number what paper works can I fill out?

Can I ask her to send an email to NVC instead of sending the actual form DS3023 for choice of agent? (I would be her choice of agent)

I instructed mom to have her BC ready authenticated and police clearance abroad (she is currently residing in middle east).

Is there anything else I should or can start while waiting?

and lastly, I am unemployed but hubby would be my cosponsor....we filed our taxes last week so that we could include. His income is enough to accommodate the 3 of us according to poverty guideline. What forms should I submit then...and what documents to include.......

Thanks for all your help!

AOS documention

Jointly filed tax return for the previous year. My question are ;

1. Do my wife need to file I-864A even my income alone is enough

2. Can I attached my w2 to show that my income is enough

3. Which income should I put in the form, my income or the joint income?

Do we really need to attachéd photo copy of pay stub for 6 months?

Any reply will be appreciated.

Thank you"

AOS documention

Jointly filed tax return for the previous year. My question are ;

1. Do my wife need to file I-864A even my income alone is enough

I was also very confused on this question. My husband's income is more than triple the required minimum income. I have asked this question in other forums too and I got mixed response. A moderator of this forum mentioned I did not need to file I-864A. However, a VJ member who had interviewed at the same location as my mother-in-law mentioned that some Embassy wants to make sure that spouse is aware of financial obligation if a petitioner sponsors a family member and thus prefers spouse file I-864A even if the income of petitioner is sufficient. So, to be on safe side, we decided to fill out both I-864 and I-864A. This is totally up to you.

2. Can I attached my w2 to show that my income is enough

I think w-2 is good to show your 2012 income. However, current income can be different from 2012 income for various reasons such as salary hike, job change, etc. This is why I have decided to include pay stubs and employment verification letter. This will show my actual and current income.

3. Which income should I put in the form, my income or the joint income?

I've been suggested that if the spouse do not plan to fill out I-864A, then you should put your individual income. If you do go with your income alone, then you should put your income only but then you can attach w-2 for the last 3 years to show that the listed income is yours and not combined. Again, my fear here is, what if NVC issues an RFE if the income I put on the form will be different from what is listed in IRS Tax transcript because we filed taxes jointly? In short, to avoid any RFE and to be extra safe, we decided to fill both out both I-864 and I-864A.

Do we really need to attachéd photo copy of pay stub for 6 months?

This is to show your current income. It' is not required, specially if you're well above the required level. My list contains documents that are probably over-prepared.

Any reply will be appreciated.

Thank you"
