Thanks for all the great information and ideas! My parents are the sort of people who would never ever accept rent from me though, and would be averse to even claiming otherwise. In this case I wonder if a letter might be just as good as a lease that just says "rent is free forever"....

That's exactly what my dad said yesterday. He's like ummm no you're not paying rent and I won't sign anything to that effect. So I just typed this up:

"I, [Father's name], a citizen of the United States, do hereby confirm that my daughter, [ME], and her husband, [My Husband], will be staying at my home in [City, State] when they arrive in America. They are welcome to stay as long as they need until they get their affiars in order.

If you have any questions or concerns on the above, please do not hesitate to contact me at [PHONE NUMBER] or ."

And of course put case number and stuff at the top. I wish he'd do a lease but whatever, this will have to do. Thank God the consulate here isn't that strict with the domicile requirement!

If the NVC isn't satisfied, will they send me an RFE for proof of domicile? The stakes would be higher if there's a risk of the petition being rejected outright...

You would get rejected at the interview and then I BELIEVE you have the chance to offer more proof.

IMO, it's more, you're wasting time because you have to go back AFTER interview to provide more proof.

It's your parent's decision if they wish to follow a lease, but Montreal is a HARD embassy to prove domicile in and leases seem practically required there.

It is because the lease is legally enforceable and unless the letter is basically a short form lease then it won't carry any weight. They really want to make sure that you have a guaranteed place to live with your spouse. I would do a lease rather than chance it, but that is just me.

Yes, this is why I'm doing a lease.

I owe my mom 1.6k from buying out my apt lease when I started traveling back and forth up here back in 2009 anyways so I WANT to give her money.

I don't think she will object to letting me stay w/her for 2 months if it means getting back at least half her money.

I thought they looked at it at NVC as part of the I-864, but I saw one of the Canadian filers just got an issue at the interview for failing to prove domicile, but I believe her issue was more that the USC was planning on returning after the Canadian. Not exactly the same, but I suppose the embassy can decide there is a problem as well.

The USC, if living overseas, can NOT move to the states after their spouse. Says so in the domicile part of the I-864 instructions.

Also, NVC reviews documents for completion, not for approval and that goes for anything. People have been told to get a joint sponsor at the interview even though the NVC accepted their documents and everything. Last word goes to the consular officer at the embassy, which is why domicile is so specific to country. (Technically last word is the border person/guard at the point of entry, but people are RARELY refused entry at the border if they've got an immigrant visa.)

Ah, I see now how it works. Good insight there. Does evidence of a bona fide marriage also work that way, or does it have to pass some earlier hurdle because it's part of the original I-130 package?

updated social security card and passport biographic data page showing name change after marriage(I mean who would bother changing their name on their SS card and passport to their married name if they weren't intending on living in the states)

Letter from my wife's daughter in the states that we are going to stay with her, AND a lease(she rents an apartment herself, so it has the landlord's signature as well as hers and my wife's).

photos of my wife's stuff which is still sitting in her daughter's garage being she never even bothered bringing it here with her knowing this would be temporary.

OriZ, if you're still there, how did you get "Proof of voting in recent elections"? All I can find for my state is proof of voter registration.
