I can understand Panera's problem...the shoppping center is playing semantics.

As a previous businessperson in the salon industry, I can say that we had always locked the landlords into exclusive clauses in the lease. You're putting your money building a space that is in actuality, not yours, therefore the shopping center shouldn't be trying to be a rent piggy by slitting your throat.

Sandwich, burrito, whatever.....it's bollocks

But do you think Panera would be complaining if it were a Hot Dog-On-A-Stick or Chinese Noodle place? IMO, they should have been smarter about what the lease agreement said. Maybe they should sue their own lawyer for incompetence? B)

This was on the news last night here. They were debating sandwich vs. burrito, and then wrap got thrown in there too for some reason. I think wraps are sandwiches, but not burritos.

OH :o That is interesting. Hmmmm... Still, I think the error was in the wording of the lease. If they were concerned about a direct competitor (another sandwich shop) then it should have been more specific as to what they consider a direct competitor.

Well as we don't know the exact specifics of the lease other than the wording 'sandwich shop'...I'm going to refrain from commenting. Who knows? I do agree with the fact that it was probably worded improperly, but I don't know what the intent was that they were trying to convey, and whether or not there was any verbage in the agreement which superceded the words 'sandwich shop'

As far as 'would Panera have sued if it was hot dog on a stick?' I don't know....I'm not a fortune teller :lol:

Wraps are not a sandwich either. Sandwich is something between slices of bread, normally 2 slices.

Is a sub a sandwich? In bread where you have to slice half way to put the bits inside?

No sub is not a sandwich either, since it's on a subroll that may or may not be sliced in half. Mom never gave me a PPJ on a subroll. It was on 2 slices of Wonderbread.

Hate Qdoba. Actually, I can't stand any fake Mexican, really. It's over-priced and tastes like what it is.....corporate American fast food. It's upscale Taco Bell, basically.

Lady, people aren't chocolates. Do you know what they are mostly? Bastards. ####### coated bastards with ####### filling. But I don't find them half as annoying as I find naive bobble-headed optimists who walk around vomiting sunshine.

I agree it is overpriced - it's my Baja Fresh substitute. We don't seem to have those on the east coast.

Fast food requires cheap labour.

Not necessarily fast food either - I was in Bloomingdales flagship store in NYC yesterday. They have a chocolate shop which sells chocolate for $3-$5 per piece. You can actually see them making the chocolate in the store - they seem to have the exact same pasty, pimple faced teenagers running things.

So if a sub is a sandwich even tho the bread is not two pieces of singular bread, if I were the attorney, I'd fight that a burrito, is in fact, a sandwich. :lol:
