asked this in other section of forum but was referred here for more info. just wwnt to be sure i understand i understand the petition process correctly. i was under erroneous impression that the visa processing fee meant the i-130 process. i got that clarified by someone on this website. so, i submitted i130 petition for spouse. i am citizen. i submitted nothing else since she is not eligible adjustment of status due to entering without inspection. do i wait on i130 to be approved and then NVC will notify me that i need to pay for visa process? is there a separate applic

ation i have to submit at that point when paying for visa processing? i know i-601a cant be submitted yet, but where will they be sent once march 4 comes? thanks for any guidance i can get.

Hi! I am also filing I-601A tomorrow for my husband. Here is the process:

1) File I-130 Immediate Relative Petition: wait for response. If your spouse entered w/o inspection and does not qualify for Adjustment of Status, THEN USCIS will send your approved I-130 (assuming it is approved) to the NVC and notify you in writing that they have done that. Within 30 days or so you will receive notification from the NVC that they have opened a case for you. You should email nvci601a at state dot gov and let them know that you are filing the provisional waiver. This way, they will wait to receive your approved/denied waiver before closing your case and making an appointment at the designated consulate. Please note that you must continue the process below, it just prevents them from closing your case. IF YOU DON'T DO THIS THEN ONCE YOU GET ALL THE PAPERWORK IN THEY WILL CLOSE YOUR CASE AND MAKE AN INTERVIEW APPOINTMENT IN THE HOME COUNTRY. IF THE APPT IS SCHEDULED THEN YOUR WHOLE PROCESS WILL BE DELAYED.

2) They should instruct you to pay the Affidavit of Support fee and for your spouse to file a "Choice of Agent" Form. Depending on where you are filing (the home country of your spouse) will decide how much of this you can do via email. Much of the NVC process can be done via email IF you immigrating from a country that does online stuff. Our country (Honduras) does NOT. We were able to file the Choice of Agent form (DS-3032) via email, but had to file Affidavit of Support with regular mail. The Affidavit of support fee can be paid online and is $88.

3) AFTER the Choice of Agent form is received by them, they will notify you that they have received it. After the Affidavit of Support fee has been paid and shows "paid" on the receipt, you will get instructions for paying the Immigrant Visa Fee and filing the Immigrant Visa Application. You must pay the fee (can do online), which is $230. Eventually, this will go from "processing" to "paid". You can print the receipt that says "paid" and include it with your waiver and file the I-601A at that time.

So, what can you do if you haven't already completed the IV process and want to file I-601A? You can work on your waiver letter, collect letters of support, and basically make sure you have all your documentation together so that once you can file your waiver, you will be ready!

thanks, mixed status. been out of the loop for a while just waiting to hear about i-130 status, but i know that will take several months. i will take yur advice and begin to work on stuff i will need..including the translation of spanish birth certificates etc..i don't see that you mentioned anything about the medical exam...did your experience not involve that or your not at that point yet? thanks again.

I have same case as your i filing in july. let me know update please...

Our case was and is complicated, so my update will probably not do anything to encourage you. I won't go into details, but it was denied. We ended up having to hire an attorney who dug up my husbands entire immigration file, revealing a lot more info than I was ever aware of. We are still in the USA and haven't had any run ins with uscis since denial. Praise The Lord.

Old post, but the answer is that the med exam comes after the trip is made to the home country, before the interview.
