I feel like this post should be closed.

Visajourney is here to answer legitimate questions (i.e. how much is this form? how do i fill it out? how do i prepare for interviews?)

The person posting this clearly knows they are doing something wrong, and also seem to know how they can fix it. Any information given to him/her beyond that point is encouraging lying, whether it is asking her to leave, or telling her to stay.

Its all a slippery slope. I don't think the moderators want visajourney to get a reputation of helping people who have committed misrepresentation.

Sorry to the person who created this post. You are in a tough spot, but this site is not here to encourage lying. If you want legal advice from now on, you should consult an attorney, not this site. Tons of cheap/free attorneys out there willing to help.

I doubt that the government investigates people on visa journey for fraud. But in reality, that fact that you're worried about what you've posted being seen by the government should give you an idea that its not a good idea. Some people do adjust status from non immigrant visas and everything works out. However, your intention for coming here will be highly scrutinized and you'll have to hide the fact that you came here to be with your. Not a good idea

Bottom line is this, don't screw around with this. The outcome of this process will affect your life in a large way. Either get married here and go back home and begin the CR Visa process or don't get married and go home and start the K-1 process. NO ONE on here wanted to be apart from their loved ones. What you are considering has the potential to keep you away from your loved one permanently, assuming he won't move back to your country. If you do the K-1 or CR, you'll most likely be reunited in the states a year from now. Nearly everyone on here lived through that....... so will you. Once again, we all know it sucks. Paying taxes sucks.....

Thank you, I agree with everything you have said and we will probably apply for the cr1 visa thing. I can stay here until August so I will do so and apply for the cr1 soon and then go back home and come back on a tourist visa until I can get back here for good. I have thought about it all and I don't wanna risk anything, I also don't want to break the law, and I won't.

Get married, file CR-1 and go home and wait it out for 6 months like the rest of us. It was nothing nice for my wife and I to be apart for 6 months but we followed all the rules. Doing what you are talking about and just staying is part of the reason it is so difficult for many people to get visa's and why people are hard on you. Many people here cannot have family members from foreign countries visit them because so many people do what you are thinking about doing.

The OP sounds young - not only the language used but also the information given in her first post leads me to believe this.

So assuming that I'm right, I'm going to be a little gentler with you. Yes, I agree, do not lie to the US government and US immigration ever. Okay, so now that we know that, let's look at your options and situation.

If you want to minimize time spent apart, then I would get married earlier than later, and then do as ValerieA suggested and BE SURE not to over stay your visa. Go home when you are supposed to. If it ends up being a lengthy process then you can visit again or your husband can visit you.

You mentioned in your original post that one of the reason that you didn't go the K-1 route was because of the financial support issues. This is going to be an issue whether you choose the fiance route or the spouse route. Your husband will need to find a someone who is willing to co-sponsor you.

You should also know that it is perfectly legal to visit the US with the intent of marrying here. What is not legal is the intent to STAY in the US on a visitor's visa. You could have done this right in the first place. If you fill in some more information about yourself, like where you are from, people may be able to give you more specific advice.

And here I have a question for you, and for some of the experienced folks on here (I don't have any visitor visa experience) - if your address changes while you are in the US from the one you listed on your visa application, is there someplace that you can go to change it? Now, I ask this from the standpoint of someone who actually meant to stay at their stated address, but if the OP could change her address now, then that might be something to look into.

And my last little bit of advice is this ... there are people on this site who have so much information to give that it is unbelievable. And they give this info for free. Regardless of what response you get, you need to stand with your hat in hand and humbly accept the criticisms, because with them will be advice worth their weight in gold. Many of us spent years wrapped up in immigration. It is not a fast process -- ever. But we also know that regardless of how long it takes, the reward is that we have the rest of our lives to enjoy with our spouses. This is just an exercise in patience. Patience that is also needed in a marriage, by the way.
