Yes, same for the K-1 route. You're fine as long as you don't overstay your tourist visa. Anyway, you will HAVE TO go back to your home country to finish the CR-1 or K-1 visa process (you will have a medical and interview to attend).

alright, so on the white sheet of paper it says i can stay here until august, even tho i told them i was gonna be here 2 months...so will it be ok if i stay til august? wont that make anything difficult

you have already made things difficult for yourself for having lied to CBP about where you are staying while you're here. This whole thing is a hot mess. no0pb.gif

Yes, you can stay until August. Don't stay past the date on the I-94, but you can stay up until then.

CR1 is about 1000 total. But really all of this.... is cheap compared to the cost of moving to another country.

and also, do we need to do the same thing like with the k1 visa, proving our relationship and what not?

Don't lie any more. Go the legal route. You are allowed to get married on a tourist visa. You just have to move back to your country to wait for the spousal visa to process. What's 10-12 months apart when you'll have eternity? Do it the legal way, less headaches... :)

I-130. Start exploring the USCIS.gov website and read the instructions, there's quite a bit of answers that you can find by yourself.

And yes, you need to have proofs of bonafide relationship with the spousal visa, and they better be strong.

alright, i will, but the thing with them checking the website scared me i wont lie. can i seriously get in any trouble?

try to get a lawyer. i do understand that most people here worked their #### of just so they can be with their love ones. they are doing the right thing.

you on the other hand is planning on doing the short, not so legal way.. get a lawyer.

if not wait for the new law to be pass. if i am not mistaken obama wants the illegal immigrants to be legalized. maybe it will work on your favor. however, i am not saying you are illegal.

just maximize your stay there. be with your love one. enjoy every moment. maybe your partner can find a work. then he can petition for you.

if you are meant to be together, few months apart is nothing. My wife and I had to be apart for many months and yes it was hard but we could do it and now we are together and happy for all the years to come and at the end few months or a year is nothing compared to the rest of a life together.

Do it right, this country gives you that choice. Just follow the advice you have been already given on the forum. Do it right.

hello...so i welcome everyone to my topic, i will share my story and write about it as shorty as i can. i would appreciate any help so much, i am kinda desperate and i would love some answers or suggestions..here it goes.. so basically me and my boyfriend met on the internet years ago. we talked on and off, but we had like a two-three year break and in the mean time i lived in america 2 years as an exchange student and graduated hs. i went back to my country and started talkin to him online again, we didnt know each other in real life yet then. we started dating online in december 2011 and he came to my country for a 3 week visit in may 2012, then we came back again for 2 months, with the intent of staying in my country for good but he had to go back to america cuz he couldnt get a job in my country. we decided that we will try to settle in america as life here is just easier, i didnt wanna be apart from him for long. we wanted to apply for the k1 visa but he didnt have a job then and we didnt feel like waiting MONTHS, so i applied for the tourist visa and here i am now, my second week in the US, i can legally stay here for 6 months. the thing is, when i filled the form for this tourist visa i said that i am going to stay with my host family (from 2 years ago when i was an exchange student)in another state, so they have that down, when in reality im with my boyfriend, if i was truthful and said i was gonna see him, im sure i would of been denied that visa. so yes it wasnt the honest truth, but then again, its not like im here illegally...anyway...we wanted to get married for a while now and we prob will soon, but id love to stay here...i know that i could go back home and apply for the k1 or a spouse visa, but i dont wanna be apart from him for months again...so i was thinkin about gettin married and applyin for the AOS...i know that they can question me since im on a tourist visa, but they already 'think' that im stayin in another state with my host family, so i thought i could just say that i have met my husband to be while i was visitin with my host family. what do yall think? can this be risky? i know its all expensive, i know its better to get married after a while and not immediately after my arrival, if i had succeded getting the tourist visa, maybe this could work too...i know that its legal to get married and adjust the status, as long as that wasnt planned from the start, i cant say that we planned this, we wanted to get married and for me to stay here for good, but we were mostly thinkin about the k1 visa, but i dont feel like going back to my home country...

Hey ! Well I would never believe that story you told. There is so many red flags and not much sense in your fake story, and honestly i would never take the risk..what if you get banned then you never can even visit the states, much less live here with him. Its not worth it, just for a bit of a wait. I mean you sound kind of young the way you think , im not trying to be mean at all! Im just bluntly putting it, your new to this, and I really dont think that story will pass.

I sympathize with you. The system is quite flawed. The new immigration reform that they're proposing basically decriminalizes illegal immigration for those who entered US borders illegally. If they're going to do that then it's only fair to completely decriminalize all forms of illegal immigration. Let's go back to the 70's when any spouse of a US citizen may be entitled to citizenship/PR status, regardless of their intents. It would make the process a lot smoother for all the real couples who undeservedly need to have their finances and relationship scrutinized for 1-2 years and then even getting interrogated before being given a letter of temporary intent to issue a visa.

Is Obama's 2012 immigration proposal already in effect? The one that allows spouses of US citizens to remain in the country while waiting to obtain legal status? If so you can get married, file a CR1 and legally stay in the country. Perhaps you should contact an immigration lawyer for advice.
