Filing i-751 with Missing AR-11

Hi VJ Members,

I am almost ready to send my package to USCIS

just wanted to ask something.

I enter in US in may 2011, then i stay with my in Laws (i got my GC on the same address)

then in Late 2011 (17 Nov) i moved some other state due to my job, where i stay with my friend with almost three or four months (i did not lease or co-lease for that period) and i did not fill the AR-11 for that stay.

then i lease my own apartment in the same city/state in March 2012, i filled the AR-11 for that,

Again in July 2012 i lease another apartment upon the lease contract end on my previous apartment. I filled the AR-11 for that.

My question is, would that be a problem for my first move(with friend) for which i did not filled AR-11 online. if so, should i include this address to the i-751 form or only the other ones for which i filled AR-11.

any help will be appreciated. Thanks

No, it will not be a problem as your current address is already communicated (remember the intent of USCIS is to have your latest address for contact). In I-751 in Part 1, you fill your current address (and under mailing address too, unless you want that to be your in-law's address fo any reason) . I don't see any requirement to provide old addresses in the form - am I missing something!

I trust that your US spouse filed I-865.

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

No, it will not be a problem as your current address is already communicated (remember the intent of USCIS is to have your latest address for contact). In I-751 in Part 1, you fill your current address (and under mailing address too, unless you want that to be your in-law's address fo any reason) . I don't see any requirement to provide old addresses in the form - am I missing something!

Yes, they asked for all previous address, on section 3 point number 5. my wife did not file i-865, do we still need to file that although i am ready to send my 1-751 package (including the copies of AR-11)... please advise...

  1. You mean Part 3 (Additional Information About You) question 5 (Are you in removal..... Yes, please do provide them will al the right details, including your stay with your friend for 3 months.
  2. Your US spouse responsibility will continue till you become a US Citizen or .... - she needs to file I-865 for the latest address.

I was just reading the i-865 instructions,

The Sponsorship agreement remains in force untill the sponsored imigrant:

1. Becomes a US Citizen

2. Can be credited with 40 Quarters of work (As i am doing a full time job now, does she still need to file that 1-865)

------i think above point means 10 years of work in US

My bad, i miss understood it, in my case one of my wives family friend file the AOS for, my question is, in that case who will file the 1-865 (my wife or her family friend)?

40 qualifying quarters of work takes almost 10 years and the immigrant can become a US citizen after 3 years of stay in US. Hope you got it.

All those filed I-864 must file I-865 whenever they move from their current address.

Meaniong, if your wife filed I-864, then she needs to file I-865 (I presumed she moved with you).

And if wife's family friend moved from the address given in his/her I-864, then only he/she needs to file I-865 esle there is no need.

I just sent my 1-751, I am sure will send i-865 tomorrow sometime. i hope late filing will not be an issue
