The Hartford Office Sent my unapproved I-130 to Copenhagen

Capri, USCIS still lists my address as being in Connecticut. I asked yesterday on the phone. They've processed no address change for me yet and don't have a service request in for one.

The field office in Hartford is blatantly wrong. They moved my petition because they think that USCIS doesn't have jurisdiction at ALL, not that I would be better served by a different field office. I'm putting money on that they don't know that DCF is dead in Denmark and didn't get the 2011 memo. Why not shift the case back to NBC?

No one other foreign residing couple on here has been processed at a foreign field office, save the ones who actually live in those countries, i.e. UK. This is not normal and Hartford isn't even sending it to the London Field Office, so they obviously have no idea what they are doing.

I tried calling the embassy today in Copenhagen but they don't have phone hours until tomorrow. I've forwarded the email I got from the Senator's aid to the Stockholm IV unit with the hopes that they can sort it out.

Next on to London to email them! Wheee!

Then I would contact London and see if they have any means of retrieving your case manually themselves since they seem to be the ones that should be adjudicating it.

When I was filing from abroad and really confused about the process, I contacted the field office who had jurisdiction over the country I was living in (living in Kuwait, but Greece was the field office). They told me they do not adjudicate petitions from any of the locales they have jurisdiction over. I would assume it is the same system here.

While I would be really hopeful that London may do something with the petition, I don't think I'd count on it.

I wish I had some helpful response for you Nola...good luck with this!

London pulled through!

Dear ******,

We apologize for the erroneous information you have been given throughout this process. USCIS does have jurisdiction over cases filed abroad and your case should have been sent to the Chicago Lockbox for processing as there is no USCIS field office in your country of residence. Having said that, please go to the below website, utilize the checklist located there for filing I-130s, prepare another I-130 package with no fee, mail it to our address in London at the address located below under "International Mail". We will adjudicate your case and FedEx the case to the Embassy in Denmark.

Please enclose a copy of this email with your I-130 so there is no confusion when we see a case received from outside the United Kingdom.

If you have any questions you can call us on +44 207 495 0551.

Yup. Where to have the interview, though, is still up in the air, but there only be 2 choices, aye? London or that other city in the EU .

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I know, right? She responded back so quickly too! We will be expressing the I-130 tomorrow and it was actually a simple procedure to put together because London wants no bonafide evidence or anything and has a checklist all done out. I did have to go into the city center to get a photo for the G325a, but that is small beans compared to this.

I hadn't really researched how to do DCF after NOA2, so I'm going to have to figure that out. I think we just bring all of the AOS stuff to the embassy, right?

Capri, USCIS still lists my address as being in Connecticut. I asked yesterday on the phone. They've processed no address change for me yet and don't have a service request in for one.

They dont have your address as CT, whoever you asked gave you misinformation. Just as they did on Jan 30 when you called and asked where your case was and they said 'its def NOT at a field office and it had been at Hartford since Jan 23rd. The reps on the phone (even tier 2 dont always know everything as its happening) Your address was changed- thats why Hartford stopped processing you on Feb 15 and bumped you- because your address changed and you were out of their jurisdiction.

I dont even know where to begin addressing this.. They are not blatantly wrong. The only thing they did wrong was Hartford sent you to Copenhagen instead of London. NBC does not adjudicate stand alone 130s. Everyone got the memo. They go to the local office with jurisdiction. If you lived in CT it would be Hartford. If you live in Denmark, it would be London. So NBC sent you to Hartford because at the time you had a CT address, it was corrected and you shouldve been forwarded to London, you got sent to Copenhagen by mistake. You are never going back to NBC.

No one other foreign residing couple on here has been processed at a foreign field office, save the ones who actually live in those countries, i.e. UK. This is not normal and Hartford isn't even sending it to the London Field Office, so they obviously have no idea what they are doing.

Every single file after the date of the memo who has a stand alone 130 is adjudicated at a local office whether they realize it or not. They all go from the NBC to a local office. Most people do not realize this because they are not notified when they are transferred or that they are transferred at all. The case number doesnt change, all they see is its a MSC case number and it seems to go from NBC to the NVC, but the actual adjudication gets done at the local office. For people in countries like Denmark, Norway, Finland, Iceland, UK, and Sweden, it happens by Officers in the London Field Office.

I tried calling the embassy today in Copenhagen but they don't have phone hours until tomorrow. I've forwarded the email I got from the Senator's aid to the Stockholm IV unit with the hopes that they can sort it out.

Next on to London to email them! Wheee!

Regardless of all that, since it is now clear that London Field Office has jurisdiction over your 130, you need to send in your expedited request to them for processing ASAP. Once they approve it, they will forward it to the NVC for visa processing.
