Hello Everyone,

I have been through the K-1 Journey and now i am in AOS journey. My question is that my wife's AOS is pending. We got her SSN on there it says that "valid for work only with the DHS Autorization." does she still need to apply for the employment Authorization??? Please Help

2-14-2006: I-129F Mailed Express

2-16-2006: TSC recieved it and signed

2-24-2006: NOA 1 recieved

2-27-2006: Check Cashed

5-01-2006: CASE APPROVED!!!!!! NOA2 by E-mail.

5-06-2006: NOA2 by Mail!!!!!!!

5-17-2006: NVC Recieved The Case!!!

5-19-2006: Left The NVC And Was Sent To Consulate..Mumbai, India!!!!!

5-25-2006: Consulate Recieved The Case

6-01-2006: Downloaded Packet 3 was Sent to the Consulate

6-04-2006: Packet 3 was Recieved by the Consulate.

6-08-2006: Packet 3 was recieved at home sent by Consulate

12-07-2006: Registered to be Approved..

12-13-2006: APPROVED....WITHOUT the Interview!!! WOOHOOO!!!!

I take it she has her EAD (employment authorisation document)?

If NO get one if I find it hard to believe that she has not ot one if she has a SSN.

If yes she has then she is good to go.

I remeber 3 years ago neally I had got my EAD and had to take it to the SS office to prove I was aload to work then they sent the SSN out.

I filed for her SSN 2 week after the AOS Filing...But on the SS Card its says " Valid for work only with the DHS Authorization" What does that means??

The SSA considers all K-1 visas as "work authorized" for the term of the Visa, EAD card not needed to get the SS number, that is how a person can get a SS number with out EAD. Many states require a SS number inorder to get a marriage license and EAD can take longer than the 90 days of the K-1 visa, so the SSA made the exception for K-1 holders. However, when the K-1 expires then you are no longer authorized unless you have EAD.

So if you want to work you need to file an I-765 for an EAD.

Hello there,

Yes, she need an EAD. I applied for an EAD, and mailed it together with my AOS. My SSN also has that "valid for work only with the DHS Authorization". After my biometric, I got my EAD. That is what I show with regards to employment. My AOS is still pending. For employment , I went to the county employment agency for assitance and assessment. I informed them of my AOS status.

hi there

looking at your timeline you are already in the process for the AOS...and you have been transferred to CSC...

although she has her SS Card this wont help her to get a job..

being transferred you might be lucky enough to get approved quickly without interview... if this doesnt worry you about the wait your wife will receive a greencard which will authorise her to work....

did that make sense to you..

That's exactly what my husbands says. You have to file for the work authorization so she can work. Did you file for this with the AOS????

VERY common to have you SS card and not an EAD. The 2 really have nothing to do with each other. There are many people that have SS #'s that don't work.
