Greetings everyone,

My fiance is from Nicaragua, but lived in Guatemala for a year as a student over 10 years ago. The US Embassy in Nicaragua has said she will need a police record from Guatemala, but it's been said to us that the only way to get a Guatemalan police report is to go to Guatemala and apply for one in-person.

Does anyone know if it's possible to get a police record from Guatemala without visiting? Will she really have to travel to Guatemala to get a police record? It seems like a lot to ask. And it seems strange that there's no other way to get one without visiting in-person. Are there lawyers we could hire or people we could contact to help us?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

When I wanted to bring my fiancée and dead lost with all those immigration forms, elected to hire an immigration attorney for guidance. He told me about those criminal records, with the USCIS, we are all guilty until we prove ourselves innocent. So I called her telling she needed a piece of paper saying she had no criminal record. In Venezuela, was also dead lost on this subject even where to start to find where to get it.

I am still exactly clear on the details, but she hired a notary to help her with that, its not like here is a complete database on criminal records, still using filing cabinets. So she had to show up in person, where she lived and go to some local courthouse to get that piece of paper stating she and her 13 year old daughter did not have a criminal record.

Perhaps you can find some notary on the internet in your home country that can advise you, but be careful with that, a lot of crooks, in particular in Latin America on the internet. won't give you a quote, how long it will take, but more than happy to give you their account number at some Miami bank.

All I know is that during our AOS, they wanted to see that piece of paper, and translated into English. Found that strange as well, as met very few people at our USCIS field office that were fluent in English. Not even the then director of the USCIS, Emilo is not fluent in English, one reason I assume those forms are so screwed up. Going through this immigration stuff really gave me a different view on MY country.

I think she has to show up in person based on our own experiences. Ever notice the drastic increases in airline tickets? More than doubled in the last few years. Then another major competitive airline is being eaten up. Going back to the days when Carnegie, Rockefeller, and Morgan owned this entire country. The rest of us were slaves.
