The I-129 is a petition for a non-immigrant worker and that form does have 'classification sought'.

What fee was sent? The fee for the I-129F is $340. Fee for the non-immigrant worker form, I-129 is $325.

I am thinking the same thing. Can you word the rejection letter also here.

8699 are you absolutely sure the agency filed out a I-120F and not a I-129+ I have researched and I-129 you do have to put down classification sought. Do you actually have your entire package that was mailed in? I believe they messed up.

Hi Everyone! I need some help! My American fiancee applied for the K1 (f129a)back Jan 22/12. I am Canadian and we have known each other for 46 years! We received a rejection of the application due to "CLASSIFICATION SOUGHT"? We called USCIS, called the firm which prepared our papers and had a consultation with an immigration attorney. USCIS could not provide us with any information told us to consult with someone???...If they don't know what it means WHO DOES? Clearly we provided all pertinent documentation including cover letter describing our intent along with the necessary forms. We redid the cover letter (to make it plainer than day) as there was NOTHING missing that we/document preparer/lawyer could see.. We resubmitted 10 days ago and BOOM! Rejected again....document says "missing" "Classification Sought" Wouldn't you think that the fact that there is the F129A, and all the other documents including the DHS documents it would be ok? ANY IDEAS?? My fiancee did get and INFO PASS appointment in Las Vegas for Feb 22 at the USCIS office...Will they know something different that the people on the phone? We have wasted a month already!! Are we missing the interpretation of this term? I even tried to think backwards ie..ok so perhaps you cannot apply if you are not eligible..we are both divorced and provided documents to prove same. ANYBODY have a thought? I would so appreciate it!! its like we all become lawyers eh?

"Classification Sought" is a term used when petitioning for an "Immigrant Alien Worker"

Alaska2012 - Call back on Tuesday when uscis are open again, demand to talk to a tier 2 person and ask them what they mean with classification sought. The tier 2 will know. To me classification sought sounds like they can't determine what visa you are applying for....but that makes no sense either since you sent along everything you needed. Please keep us updated and good luck!

I agree - great advice - Another thought as well - Remember that once you have decided something is true or not true - "We did everything right" - that becomes a stumbling block to seeing what they see. Go to the guidelines section as told to do earlier and compare everything you are doing to what they say needs to be done - Reconstruct your application one line at a time to see what is missing. There are a lot of ways the application can be rejected if an i wasn't dotted or a T wasn't crossed - Good Luck

Hi well it definetly was I-129F petition for alien fiancee, money order $340..cover letter stating same...even an in depth story about us! what could be more clear tham the top of the page saying I-129F petition for alien fiancee. will try calling uscis again monday and ask for 2nd tier person.

We didn't prepare the papers, it was done by an immigration service and reviewed by a lawyer!! i wish it was a senior moment!!

When you re-submitted the second time did you use the same form from the first application? Or did you start from scratch and download a new form from the USCIS website and fill it out again?

Returned once could possibly be a mistake but returned a second time? It looks like there is something wrong with the form.

Did the immigration service download the forms? Do you have the actual form there with you right now? Can you compare it against the current I-129F on the USCIS site - check the small print at the top and bottom of the form. What is your form's expiry date for example? See if you can spot any other differences.

If I was you I would prepare it all myself. On this website there are useful links and example forms. That's how we did it. Maybe the immigration attorney knows less than he claims he knows.

What address did you send your package to, if you mailed it to the wrong address, it would be returned with the check not cashed; wrong classification could mean you sent it to an area of USCIS that does not adjudacate fiancee visas. Based on all the information you have written, this sounds like the most likely result.

Where does your fiancee live? I'm wondering if there is someone on the forum that lives close to your fiancee who might be able to help out and make sure the correct forms are filled out. I'm on the other side of the country and can't.

That's what I was thinking of too when I've read all this!

You should have checked "Other (Specify)" and specify it as "I-129F"

I really hope you find out why it's been sent back. :idea: It's really weird that they didn't cash the money though...

Well, or hope for some explanation on February 22nd when your fiancee has the appointment...
