You realy need to read the k3 FAQ and AOS guide. :guides:

http://www.visajourney.com/forums/index.ph...mp;page=k1k3aos

http://www.visajourney.com/faq/k3k4visa-aos.html

http://www.visajourney.com/faq/k1k2visa-aos.html

You should be able to use the medical data from overseas,it is valid for 1 year. Fingerprints will be retaken at the biometrics appointment.

Fees are subject to change:

Look for them on the USCIS site with the forms: USCIS Forms

13. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)
http://www.visajourney.com/forums/index.ph...mp;page=k1k3aos

You should have a copy of the medical form from overseas.

Strange the links did not work, anyway they are just the tabs at the top of the VJ page (Guides} and (Visa FAQ) Just pages found in those pages.

The lawyer quoted that because they added their own fees. EAD is an additional $180.

If you follow the guides here on VJ carefully you wont need a Lawyer at this point.

Good luck!

Unless your husband doesn't plan to work you should pay the money and get the EAD. One week of pay in the lowest American jobs will cover the EAD cost. There are also some benefits of identification that wil come in handy if you are not so lucky in the AOS process. Every once in a while there is one that takes a long time for no apparent reason.

I second that!

When my husband and I filed for his AOS, we were transfered to CSC right away -- which usually means GC w/in 30 days, no interview -- and we thought we'd wasted $180.

Well, it's been 6 weeks since his AOS app was touched by CSC, Almost two months since the transfer, and I'm so glad we filed for his EAD, which we received two weeks ago. It not only allows him to work, but allows him to go to Uni (local college wouldn't take him w/o EAD to "prove status") and get a driver's license (which he also couldn't do in this state without his EAD).

Look at it like insurance premiums. You pay hoping you won't have to use it, but if you do, it's a safety net you'll be glad you have! :D

One thing that hasnt been answered by the others... You cannot E file or file in person for your AOS... it must go to the chicago lockbox and from there gets sent all over the countryside.

K3 can't get a SSN or a driver's license unless they have an EAD. In most cases, the AOS process is going to take longer than 90 days, so you might as well apply for the EAD, and eat Ramen noodles for a week rather than go without it.

He's not going to be able to do much of anything until he gets the EAD or the green card, (min. 3 months after arrival) so stock up on some DVDs to watch or some home renovations for him to do ;)

Domini,

I would suggest that you file for AOS and EAD at the same time. That way you don't have to do the paper chase game you will have to play if you E-file for the EAD. But remember when you do file the paperwork make sure you have to forms of payment (AOS and EAD) with the appropriate amounts. MOST OF ALL MAKE SURE YOU MAKE COPEIS OF THE ENTIRE PACKAGE before you send it in.

Side note. Make sure your SO's name is on your mailbox somewhere, that way you are pretty much assured that he/she will get mail and the postal person will become familiar with the name. Just my 2 cents worth of infor. :-)

Good Luck.

Actually, you'll have to file the AOS *BEFORE* you e-file your EAD since your EAD is dependant upon your c-9 status as someone who's in the process of adjusting status.

Can't put the cart before the horse and all that. ;)

Not true. domini is a K3, actually better off applying for EA before applying for AOS.

Some carts have rear-horse drive.
