Hi,

My spouse and I are buying a house, and we expect to close about about 45 days before my green card expires. Since we don't want to deal with the hassles of changing the address while filing I751, we decided to wait until we officially move into the new address. Also, we can use the joint ownership of the new house as evidence.

My questions are:

1) What evidence will USCIS accept for the proof of the joint ownership with my spouse? I am not sure what documents we will receive from buying a new house, and when we can get them. For example, do we need to wait for another few weeks before receiving my new title? we definitely don't want to wait much longer. What do we receive before the closing date is sufficient for USCIS?

2) Anything else do we need to pay attention to regarding my situation? For example, we assume we still need to file AR-11 (change of addresses form?)

My wife and I are a few months away from ROC but I plan on using the title from our house as well. Laws vary state to state but I would ask the notary at the closing if they could make a copy of the notarized title for you. That would be as good as the title after it is filed (and you are normally sent a copy). My guess is it will be much longer than 45 days before you get the title back. Keep in mind there is all kinds of paperwork involved in buying a house that should have both your names on it which you can copy and send which will be almost as good as the title.

The one document that comes to mind is I think it is called the HUD-1. It is the settlement statement that lists the buyers and sellers credits/debits. You usually get the first copy when you apply for a mortgage as part of the good faith estimate.

That or the actual loan document though that tends to be around 20 pages long.

joint income tax return, tax transcripts, joint savings or checking or both bank accounts. homeowners insurance with both names on the policy when you move into your new house. copy of the deed to your house or if you are making payments to the bank, have receipts with both of your names on it. maybe you should get a letter from the bank stating that both of you had bought the house. with 45 days left after you moved into your new house should be plenty of time for you to send in your 1-751 package. also, medical insurance having both of you cover on your or your wife's insurance card. good luck.

yes, ar-11 change of address. you can do this online but make sure you print out the confirmation once you do it. also, your amercian spouse has to fill out form 1-865 change of address. 1-865 form has to be mail out to uscis. once they received the 1-865 change of address form, uscis will send you a receipt which is a confirmation.

:thumbs:I agree, also you can get a PMB, find a mail box business and just change your mailing. It is also very secure.

All the above is great advice. However, if you are still days away from closing, and needing to file your i-751 before closing, I recommend having your realtor notarize a copy of the contract you signed when you made an offer. No doubt, waiting on the title or in some states, "Cash Deed, would be best to send a "court" certified copy. Again, it depends on your time frame option and paperwork offered by your state.

There is no need to wait till you close without real benefit. The joint mortgage application or approval of the loan or the correspondence from the builder or some other document ... are good enough to proove your intension of joint ownership. Please remember this is not the only document to support your inter-mixing of finances and as such I advise that you file close to 85 - 90 days prior to your GC expiry, so that you get your entension letter in time and might not have to run around for info-pass......

45 days is not bad but why risk for addiotional real benefit. Well it is just my 2 cents advise and the decision is absolutely your.

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Hi Navyk, thanks for your reply. I am concerned only because I don't want to change my address in between. I am afraid changing my address might result in loss of mails.

Change of address in between is really no issue but it is your decision.

Please note that you can also get the mail redirected from previous address to the new address for 1 year with a request made at post office -no need to go to post office and can be done online @ USPS.com.
