Hi, I came to US on a student visa (F1) and graduated in 2010 december.

Right now I am on OPT and its going to expire in 5 months.I met my wife in oct 2010

and We got married after 5 months. Its been almost two years of our marriage. Actually

we live with her parents and she goes to School. She is not employed or worked anywhere.

My question is, Will I have any problem while filing for green card ? Do I hire a attorney

or can I do it by myself. What do I do next ??

Please help.

Thanks

Nick

OP is not filing for adjustment of status from a family based visa - but is filing for adjustment from a F-1 student visa. Moving to the adjustment of status forums from student visas.

Nick:

You don't need an attorney, seriously. Just use this site. I used this site, no attorney and got approved on the spot. And although your wife is the primary sponsor (even if she has no income- since she is the USC) but you guys can include additional people for affidavit of support, as such, her parents. No worries, if you search this site, you'll get your GC in a breeze! :) Good luck!

You don't need a lawyer. My husband and I are both in school actually, and my mom just helped sponsor him. I filled out all the paperwork on my own and sent it in, the office received in 11/6/2012 and we got final approval on 2/6/2012. It took about 3 months. Just as long everything is legitimate and you can prove that (photos, financial statements, etc) then you can do it all yourself. Save yourself $3000.

Husband was switching from Student Visa to Permanent Resident (in his last semester of his program)

10/29/2012 Sent Package (I-130, 485, 765, 864, and 131) to Chicago Lockbox via Priority Mail

11/1/2012 Arrived at Chicago Lock Box

11/6/2012 Received 4 Acceptance text messages and emails with receipt number

11/7/2012 Filing Fee Checks Cashed

11/12/2012 ASC Appointment Notice

12/06/2012 Biometrics Done in LA

01/02/2013 Received notice for Interview Appointment on 02/05/2013 (notice said to get medical complete as well)

01/22/2013 Received EAD card

01/26/2013 Went to USCIS approved Physician to complete medical, picked up results on 02/02/2013

02/05/2013 Interview at USCIS, Gave office medical results, Approved pending Affidavit of Support (originally I only included my mothers, but that day they said I had to include one as well even though I'm not working)

02/06/2013 Dropped off my Affidavit of Support to the office in LA, Finally Approved!!

02/14/2013 Received official letters

02/16/2013 Husband's Green Card Came in the Mail!!

Overall the process until approval took about 3 months. Not bad and didn't even have a lawyer.
