i do not understand what you mean by you are a citizen by birth but born in a foreign country and yet you want to petition your mother. It sounds like you are saying you got citizenship through your parent though born in a foreign land. So how come you now want to petitiony our mother?

could you break that down to get clearer answers.

anyway for people planning to petition their parents, they need a birth certificate that has both their names and the name of at least the parent they are petitioning included as part of the initial petition ( I-130).

I acquired my citizenship from my father and my father died right before he can file a petition for my mom so now that i turn 21 i will be the one to do so. so to be clear my question is can I use my "Consular Report of Birth Abroad form fs-240" instead of my birth certificate issued from the Philippines to prove that she is really my mom. because what I saw in my form fs-240 is that there's a section that says parents so logically thinking I think that this form will be sufficient but i'm not sure.

Why not have your mom in the Philippines send you copies of your NSO birth certificate? She can secure certified copies from NSO.

or

You order them yourself https://www.ecensus....ph/Default.aspx

The 1st option is a lot faster since your mom can send them within a week.

There are some errors in my birth certificate her name was misspelled in my birth certificate i don't want to take any chance it might be rejected so that's why i'm thinking of any other way to prove that she is really my mom

You need to submit your NSO BC.

Regarding the error, mom can go to the Local Civil Registry (LCR) of the municipality where your BC is recorded and she can have the spelling error corrected.

Thanks for the clarification.

yes I would still go ahead and submit the birthcerificate as that is waht is needed. She could get a notarized statement testifiyng to her correct name and mentioning that the one on the Cert. is a typo. Meawnhile you should include copy of your CBRA as part of your petition.
