I only sent the actual I-129f form

i can relate with this situation. My USC fiance only send 1-129f and all other stuff except G-325A form. now we are on more than 4 months from our noa1.so what should we expect?

Well the only thing I am pretty sure of is you will be waiting for about 3 months longer to find out......

The answer is: we don't know. You just forgot one form so you could totally just get a RFE (if everything else is in the packet of course...: did you put the letters of intent, supporting evidence of meeting in the past 2 years, etc?) proof here: http://www.visajourney.com/forums/topic/309547-g325a-help/

But as I said earlier, it also happened to members to be denied because they didn't send the G325A. Unfortunatly I have no clue what is more likely, hopefully, other members will know better.

So whatever you do, there is a risk:

If you decide to withdraw, there is a chance it is actually for nothing cause you could just have gotten a RFE and go on with the process... so withdrawing would be adding the new fee + 7 months of wait to your journey.

If you don't withdraw there is a risk to be denied and to have to refile any way... Which would be 3 months from now plus 7 months of waiting til NOA2 again, so 10 more months to your journey + a new fee.

But if you don't withdraw you also have a chance to just get a RFE, so you send back the form, and you would be totally fine. A RFE would add something like a month to your process, which is not so much.

Whatever you decide, this is your choice to make, but since you have been waiting 4 months already, I would just wait and see it through. I hope you'll get an RFE and be fine.rose.gif

I did the same thing as the OP got a denial letter after 6.5 months of waiting

Not sure if we should send in the I-290B with the required form and info, or just reapply after the 33 days pass

or maybe marry there and apply for K3

btw I-290B fee is $640

any thoughts?

I'd say wait the 33 days and refill. Appeal is long and you have to guarantee to win...

Just refile. It is cheaper. Plus you have no grounds to win an appeal as they were correct to deny you if all you sent was the I-129F form, the check and nothing else.

Refile or go for CR1... K3 is obsolete and virtually unobtainable. Plus you get the green card right away and don't have to adjust status. I may be biased tho lol. ;)

Does this mean it will automatically be turned down after 5 months or will I be sent an RFE? I've received the NOA1 in December.

Yes we decided to marry there when I visit in April and do the CR1

Against my better judgment, and having been pushed by my mother and my fiance's aunt(who is a lawyer but not an immigration lawyer), I only sent in the actual I-129f form, nothing else. Does this mean it will automatically be turned down after 5 months or will I be sent an RFE? I've received the NOA1 in December.

I know several people that successfully sent the documents that were missing, together with a copy of their NOA1 and they had their petition approved. I also know of people that did NOT send evidence and were denied after months of waiting.

If money is a problem (this process isn't cheap) I would send the missing stuff with a copy of the NOA1. It still may be denied but at least you didn't waste the money first petition and at least you tried. If money isn't a problem then cancel the current one and refile. Personally I'd go with option one because I've seen it succeed several times.

Hello Hichamel,how r u? We have the same problem. My fiance filled the form with pay and mailed it on Nov.2012 and he got the receipt last Jan 2013,.He just sent the filled form and pay,nothing else,without any of our documents. What did u do about it? I am getting worried,coz i have read this kind of problem here and just knew that it will be deny and it takes a long time to refile again.

Like I mentioned in my reply to Emely in my original thread about this happening to me... refile. You are better off IMO to just start over and do everything correctly then risk appealing a denial and still not getting approved. Since I did not know until after I received the denial, I just refiled. I am not sure what you can do now. Someone mentioned to withdraw the original submission. If that is an option, then do that and start over now. Don't wait a few more months just to more than likely get denied.

One other thing, to appeal a denial its $630 as of March 2012. So like mentioned above, it's cheaper, and I think safer, to just refile.

I remember reading about someone who did that back in 2010/2011 wehn I was waiting for the NOA2. I remember the user's name here on the boards. OP good luck with whatever it is you do.

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!

What do you mean you got a reciept? Have you been denied? If so, refilll. You have no ground for apeal. If you apeal, you'll pay the $630, wait for months and loose then have to refill. So just refill, you'll save time and money.

If this is a NOA1 that you call reciept, then I think you have pretty much all the elements to make your decision in this thread. We can't tell you what will happen to you for sure. But we stated the risks, you know the fees and the processing times... Now this is your decision to make. Take all into consideration and do whatever you think is the best for you. If you just sent the I-129F and the fee (no other form, no proofs of meeting, no proofs of ongoing relationship, no copy of the USC birth certificate, no letter of intent...) the risk for denial is very high. I would just refill even if you've been waiting for 4 months already. But I am not in this situation....This is your decision to make, and yes, it is a tough one. Just to mention that you CANNOT win an appeal unless you can prove a mistake that USCIS made that caused the denial. If YOU made the mistake (ie you forgot to include all the required documents) then there is no basis for appeal. It's a waste of time and money if you are clearly the one at fault.

Yes,my fiance got the receipt last Jan.2013 just this year. We never got denied ever since,coz this is our first time to file for the k-1 visa.By the way,how long it will take to get the filled form with a letter that was denied as u have said. Yeah,only the i-129f and the pay,nothing else. Thank u for ur advice,i really appreciated it..
