Do NOT wait for an RFE or anything else. You will NOT be accepted. I know first hand I experienced it!! Although they cashed the check, you will not be approved. Our check was cashed, 5months later we got a denial in the mail. It will state your option to appeal and that it was denied due to lack of evidence supporting the petitioners citizenship. (at least it did for us). Take this advice!!! I wish I had had it! We originally filed December of 2012, were extremely negligent and now I am going on 7 months waiting for my NOA2 for my correct petition! You will just be sort an application fee, but do not wait for an RFE which will never come! Good luck and be careful and have a wonderful day!

If the packet is incomplete, one of two things will happen, either they will return the whole packet to you, or they will send an RFE. Wait to see what happens. Don't refile yet.

Actually we have seen at least 2 members getting denied after 5 to 6 months of waiting because they forgot the G-325A when they sent the I-129F package (you can ask Novembro about it if you want. She got many advice to just wait for a RFE. It didn't happen, she got denied, even if she had been trying to send the missing form to the USCIS and to have it add to her case for at least two months. She then got married and is now in a CR-1 process... )

You can wait a little bit see, if they reject your package immediately (http://www.uscis.gov/files/form/i-129finstr.pdf ("Improperly filled forms will be rejected and the fee returned, with the instructions to resubmitt the entire package") or you can call the USCIS saying your form was filled improperly, and see if they can return it to you with your fee right away.

If this doesn't happen, withdraw your petition and refill. Forgetting a form is a serious risk for denial. RFE is probably not going to happen so don't wait 6 months only to get denied and refill then.

Wait for the RFE.

No no no. Sorry but the fact that the case has been accepted and the fee has been processed is not a guarentee for no straight denial. Again, it has happen so many times. To the OP, please do not just expect.

Just imagine this: the guy who will decide of your case looks at files all day long. He doesn't like files that are not neat or complete cause it takes him more time. When he see an almost empty file he thinks "ok, this guy must be kidding me. No way i spend time on his case, if it wasn't even important enough for him to fill all the forms. denied" Anyone who's been working in that kind of boring checking jobs know that with time you become a little bit demanding. It is easy to forget that there is human beings at the other end of the form and that sending a RFE would be nicer because they've been waiting 6 months already, and denieal is a harsh punishment...

Certain requirements must be met before USCIS may consider an application or petition for possible approval. The instruction sheet for an application or petition includes requirements for proper filing of each type of application or petition. Every application or petition, regardless of the benefit sought, must include complete information in all required blocks, be signed, and – unless the fee is waived – include the correct fee.

If an application or petition lacks the required initial evidence, USCIS may deny the incomplete application or petition, though adjudicators are urged to exercise this option judiciously, or issue a request for evidence (RFE). USCIS may assign flexible times for applicants or petitioners to submit a response to an RFE. See Appendix 10-9 . However, the maximum time to respond cannot exceed 12 weeks. 8 CFR 103.2(b)(8)(iv).

Against my better judgment, and having been pushed by my mother and my fiance's aunt(who is a lawyer but not an immigration lawyer), I only sent in the actual I-129f form, nothing else. Does this mean it will automatically be turned down after 5 months or will I be sent an RFE? I've received the NOA1 in December.

You already answered your question. Withdraw, wait and then refile properly./.....with another payment fee. The government thanks you for you double payment.

i can relate with this situation. My USC fiance only send 1-129f and all other stuff except G-325A form. now we are on more than 4 months from our noa1.so what should we expect?

Your situation is a bit different if you are simply missing ONE form. They will prob send an RFE for that one form you are lacking. RFEs are sent for little things you are missing, maybe you forgot or didnt have the right information. They just wont send an RFE if the entire petition is just not there.

If they accepted the packet, that means they have enough information to proceed. Otherwise, the packet would have been returned.

As fast as the I-129F's are piling up at the service centers, I would wait for the RFE. Withdrawing the petition will take time to process, and could set the OP behind 6 mos or more.

Just keep in mind what constitutes enough information to proceed. Correct me if I am wrong but it would probably be just the I-129F and the filing fee.
