Hello

So i entered the country on September 1st. Updated to the USCIS my address that changed from the time I applied in Paris to the moment i got here, all that by sending the AR-11 forn and calling the USCIS about 10 days after that. The personn I had on the phone told me "everything should be all right call back if you didn't receive your welcome notice whitin the next 30 days"

The personn I had on the phone didn't seem to take my address, I realized that when I never received the welcome notice and had to call again. The first people answering the phone don't update anything, they transfer you to another personn and then changed my address, gave me a case number and all.

Anyway. I had the welcome notice 2 weeks ago. Well actualy 3 of them, 2 forwarded by the USCIS after it was sent back to them and 1 to my new address.

But this morning, I received that letter saying:

"On 10-04-06 you contacted us about your case. [...]

[...]The status of this service request is:

Your permanent resident card was mailed on 9-28-06 and has not been returned to this office.

You will need to file an application to replace alien registration card (form I-90), along with the proper fee using the reason for filing the application listed under Part 2 as :

I am a permanent resident and :

a. My card was lost, stolen or destroyed. [...]

So according to them i will have to pay $260 but i never received it so i didn't lose it, it didn't get stolen from me or got destroyed while in my possession because i never received it.

But my situation is :

I am a permanent resident and :

b.My authorized card was never received

And in that case i don't have to pay the $260 fee.

Also why sending me a letter about my supposedly "lost, stolen destroyed card" and refering this letter to my phone call on 10-04-06 if they can know by not having it back that i didn't receive the card?

So now i'm filling the I-90 form (Application to replace permanent resident card)

I will call monday anyway and talk to an immigration officer but i need your opinion, experience.

Are they expecting me to file the form about what they think happened? will they proceed according to the reason they give on the letter received today to apply again?

Thank you for hleping me out i'm lost and confused :(

Sorry you are having these problems. A late welcome to America to you, never saw your post on arriving. Try this link and perhaps you can do the same to get the card mailed to you once again. http://www.visajourney.com/forums/index.php?showtopic=40910

If USCIS are saying the greencard was mailed and has not been returned to them... then you are going to have to file the I-90 and pay the fees.... that is exactly what happened to me.... I even had our congresman involved as I dont see why I should have to pay again for the card.... but no joy USCIS claim once it is mailed it is no longer their issue if it goes missing.... I was told to take it up with USPS...

So I just paid the money e-filed the I-90 and waited for the new card to arrive.... took longer to get a replacement card than it did to do AOS....
