My husband who is USC is trying to help his brother to get B2 to visit us in the US.

I did some research and i know the steps

DS-160 -> pay the fee -> get an appointment -> prove strong ties with home country

I'd really appreciate if you could answer to my questions.

1. can we fill out DS 160 form from the US for him? his English simply isn't enough to complete the form. what about the electronic signature part?

2. can we pay the fee from here and make an appointment for him form here?

3. He has a small business over there, but we are willing to cover all the expenses related to his visit. should we include my husband's w-2 form, as a prove that we can indeed cover the travel expenses?

4. he is happily married and has 2 children 7 and 4 years old. We'd like him to stay and with us for 3 months. Any suggestions how to make a complete application for him???

1. Yes you can

2. Not sure about the fee. The appt is made by phone in Romanian and he needs the proof of payment with the ID number issued by Banca Transilvania.

3.they won't look at it

4. Have him take the birth certificates of the kids at the interview. And a picture. That counts more than money, there is a window for Romanian speaking only so fill the form in Romanian. ( If I remember corectly there is a form in Romanian you can fill but I am not 100% sure )

Good luck . It is a gamble really

PS Have him say he will be there only for 2 weeks ( He doesn't want to stay away from the kids or the business too long etc ) 3 months will raise suspicion. If he gets a visa it will be for 10 years anyway so he can stay up to 6 months a year in the US

And he should have some cash in his own account. At least $ 1500

Also all the info you need is listed on the embassy site Bucharest so check there best

Exactly 3 months from the day we got married till the day I had both SSN and GREENCARD in hand !

Day 1 01/22/2013 AOS package sent

Day 8 01/28/2013 NOA 1 received

Day 15 02/04/2013Biometrics appt letter for 2/25/2013

Day 16 02/05/2013 Succesful walk in biometrics 20 days early

Day 25 02/14/2013 USCIS status changed to Testing and Interview ready for interview scheduling

Day 31 02/20/2013 Email notification that my interview is scheduled for March 21st

Day 57 03/19/2013 EAD/AP card ordered

Day 59 03/21/2013 Interview at 10.30 am Seattle Approved

Day 67 03/29/ 2013 Greencard Arrived . Applied for SSN

Day 68 03/30/2013 EAD arrived

Day 74 04/03/2013 SSN card arrived

Eligible for ROC December 21st 2014

You can fill the form out, save it, give him the application ID and let him log in to electronically sign the form. You can coach him over the phone.

2. can we pay the fee from here and make an appointment for him form here? Yes. Pay by your credit or debit card under his (the) application ID you generate while filling out the form.

3. He has a small business over there, but we are willing to cover all the expenses related to his visit. should we include my husband's w-2 form, as a prove that we can indeed cover the travel expenses? No. You don't have to include any W2s. B1/B2 visas will be granted based on his own merit. He have to have a bank account with lots of money in it. All the info you need is on the link provided above. Some consulates/embassies require an invitation letter from family or friend in the US. You can write one inviting him, and detailing that you will help take care of his expenses. I DON'T THINK THIS IS EVEN NECESSARY FOR ROMANIA. Per the instructions, you don't have to. He will be granted the visa or denied based on his own merit and the information he presents according to the instructions.

2. his kids have a hearing problem (the older one is doing great with hearing aid , but still working on a little one) and he wants to do some research if american medicine has something better to offer.

3. and of course sightseeing

do you think he should mention all the reasons? if mentioning reason #2 is not going to help him, he'd prefer not to mention it at all, as it's going to stress him for sure.

any suggestions???

I don't think reason #2 is good enough for B1/B1 visa.

Reason #3 is very valid - sightseeing, touristic and visiting places of interest. Lots of places for this reason especially our nation's capital (Washington, DC), NY, SF etc etc.

Reason #1 is ok, but not sure if logically acceptable to a CO. Again, B1/B2 visas are granted strictly per him meeting the requirements set forth in the instructions. Nothing more/nothing less. Sometimes they don't even take into consideration invite letters.

And to report back to the parents about his brother married life. Skpe works jus as well for this, married brother can skpe the parens and leave it on for 24 hours a day.

I just wanted to let you know how that statement can be used against him.

How will the broher-inlaw family be without 3 months of income, will they be able to surival?

Brilliant idea. Lets start things off by lying to US immigration by falsely saying he plans to stay only two weeks when he intends to stay for 3 months.

Any other suggestions for people to commit immigration fraud?

1. No one needs his brother to report on his marriage to his parents. A grown man who can get marry can report the status of his own marriage to his parents. He does not need his brother to come to the US to do that.

2. Can't he use the Internet and call the US? Can't his US brother do the research for him?

3. So, he wants to spend 3 months in the US sightseeing, have his US brother pay his expenses, and leave his business and family for three months?

This will smell like immigration fraud to US immigration.

Well Aaron if he is going to say he will stay for 3 months he might as well have a LOT of money in his account. It really is a white lie, far from fraud , since visa would allow him to stay up to 6 months anyway.

The word "fraud " is excesivelly used on this site and it really does not help people when they are in desperate need.

It is really painful to not be able to see your family because they couldn't get something as simple as a tourist visa just because their accounts are empty and as stated before, they don't care if the person who invites you will pay for your costs. The embassy wants you to have money in your account for every day of your trip . For 3 months I would think they would like to see quite a bit.

Mariana, you may see it as a white lie, but a lie is a lie. So let's not start out by color coding lies. If the brother would like to obtain a tourist visa he should do it without lying. Really folks all of this missing your family is not the responsibility of the US government. The brother has migrated, he needs to find a way to travel back home to put the family at ease.

Yes, it is fair for any country to expect if you are traveling as a VISTOR to their country for you can pay for your day to day expense. A tourist visa is exacly what it stands for you are visting as a touris and you have funds to pay for your expenses.

Ok . Let me revise my answer Yanka. Forget I said to ask for a two weeks visa but make sure your brother in law has in his account at least $50 for each day he says he will stay in the US otherwise he will get his visa denied due to insuficient funds
