Fiance's AOS

Good afternoon and thank you for the help! We are in the last part of our visa journey and have a couple questions concerning it!

For her AOS after coming into the United States on a K-1 fiance visa she needs a copy of her birth certificate. On the USCIS's website it simply says that. Here, it says there should be an English translation of it. Neither place says if it needs to be an official translation or simply a translation. Do we need to find someone to officially translate and stamp her birth certificate or can it simply be translated (for obviously much less money)?

We are also being crunched with time when it comes to the i-864, affidavit of support. We will get that a few days after her 90 day entry visa expires and then send it all in to USCIS. It states on this site that that hasn't been an issue in the past as long as the marriage took place prior to the 90 days. Should I be concerned? (And yes, between organizing a wedding, getting her visa, moving back to the US after three years away... I did slack a bit on this next part of the visa hence this last issue. Now that the wedding is over and I've seen family and friends again, I am back to getting this done.)

If her birth certificat is not in English ( some are in both English and the language of the country ) then you need an authorized translation of the birth certificate. It does not need to be notarized . And you submit the copy of the authorized translation and keep the original

- Any document that is not in English should be translated and CERTIFIED by its translator. If you or your wife is competent in both languages, then you/she can translate it yourself BUT you will have to include a short certification of your translation. It does not need to be done by anyone who is an official translator registered somewhere or anything, but the translation has to be certified correct.

- She can send her AOS (and EAD/AP included, it's best) package shortly after the expiration of her I-94 (90 days after her POE). As soon as possible after getting married is the best. No need to wait to do it after the 90 days, unless you really can't, but don't wait too long. Your wife will be out-of-status after her I-94 expires, which is not an ideal situation.

You needed translated copies to file your K1, and beyond, get them done in her home country by someone certified to do so. Get an extra copy of all translated documents including her driver license and driving record if their is one. Maybe as stated she can certify, but we did not and sought some one to do it. There are threads on getting it done, but you need to finish your information to get better and accurate assistance.
