Help! i-130 and i-129f both processing

Hi everyone. My husband is an American citizen and I am Australian. We were married here in Australia in April 2012, shortly before he returned to the United States.

We filed an i-130 and an i-129f in October. What usually happens when both applications for spouse are processing? Do they merge and does the i-130 take precedence? In short, can we choose which one we would like to go with? We have decided to focus on the i-130 as it will be cheaper in the long run.. (no need for Adjustment of Status) however, we have not yet filed i-130s for my 2 children. We are hesitant to do so and waste money on filing fees just in case USCIS proceed with the i-129f and we have no choice at all. We believe that if we file i-130s for my 2 children now, when it comes time for my interview, their applications will be moved up in line to join mine. Is this true?

Can someone please give us some advice?

At the moment it looks like the standard procedure is for all processing to take place on the I-130 and the I-129 to get shut down as superfluous.

Someone else can advise you about the timing of the apps for your kids... I don't know that :)

28 Jun 2013: POE Houston

08 Jul 2013: SSN received (at SSA office)

07 Aug 2013: Green Card received

27 Feb 2014: Whoa, life happened. Planning move "back home" together to Republic of Ireland by end of April.

29 Apr 2014: POE Dublin through Heathrow

15 May 2014: Received formal residency/work permission (GNIB card with Stamp 4, one year renewable) for the ROI

Thanks for replying. It seems every time we call USCIS we get a different answer to our questions. Yesterday, one guy even told us they are still processing applications from August 2011... not 2012, 2011!

It is frustrating to see people that have filed AFTER us get approved. While I am happy for them, it makes us wonder if there is something wrong with ours? Why would they vary so much?

If anyone could answer the question about the children's I-130s, that would be appreciated. I thought I read somewhere that theirs will be brought up to speed with mine so we can all interview together... I am hoping so! :yes:

You will have to file I-130 petitions for each child anyway, so it's best to file them ASAP. Even with K4 visas and status adjustment, you still file I-130's for each stepchild. Do it now and then hold up at NVC until all three can be joined.

Facts are cheap...knowing how to use them is precious...
