OK... I-485 filed with I-131 and waiting for approval but K1 visa expired. How does one fly in an airplane in the states?

no worry...your already here in US so even ur k1 visa expired it doesn't matter as all as long as you STAY IN USA...u can travel in all different US states but not outside US.Goodluck sa AOS approval mo...stay warm kabayan...

A US driver license or US state ID or your passport with NOA1 from the AOS application.

You are not illegal, as a K-1 does not expire. You have an I-94

Uhmm the K-1 expires the moment you use it. It is a ONE TIME USE ONLY visa. Then its gone.

The I-94 is only valid for 90 days. Then it is expired.

I agree... so how does one fly around the states with only a Russian passport on an expired I-94? Will it work if we bring a marriage certificate? If so, that's a pain in the butt.

Can do that or state ID or bring the noa from aos filing. Basically they just want a valid photo ID for airline check in. They don't have to see the passport for flights inside the USA. Part of why getting drivers license and stuff before the I-94 expires is good to do.

So with everything said... If you are an illegal alien with a Mexican passport you can travel by plane anywhere in the states?

If one is an illegal alien one should only be traveling in the US in order to cross the border leaving the US. That said, it is my understanding that TSA does not have the legal authority to check one's immigration status, nor does TSA have the legal authority to detain/arrest someone on immigration violations. The TSA can, however, deny entry into the so-called sterile area of an airport.

To answer your original question, one only needs a valid Government issued identification [that meets certain requirements] to travel by air within the US. If you do not currently have an appropriate valid Government issued ID then you may be able to obtain a non-driver state ID from the state in which you reside.

For example:

Obtain a Non-Driver Identification Card

DMV issues DC Non-Driver identification cards to District residents who are at least 15 years of age and do not hold a valid driver license in DC, another State or Country. A DC identification card is valid for up to eight years for US citizens and may vary for non-US citizens (according to the US immigration expiration date). Certain DC residents are eligible for a free non-driver identification card.

Non-US Citizens may obtain their Non-Driver Identification Card at any DMV service center.

Could not edit the previous post to HIGHLIGHT the last sentence, but of special note is:

Non-US citizens are required to provide proof of their Social Security Number (SSN) or obtain a letter from the Social Security Administration indicating they are not allowed or eligible to obtain a SSN.

So one does not have to have a SSN to get this valid Government issued ID.

Your passport is fine, they only want proof of your identity.

And, actually, technically I don't believe you even need a government ID. You will just have to go through additionally security checks such as a pat down. This has happened to me several (probably about 4) times in the past (I always seem to lose my wallet when I'm on vacation, oops!).

Once you get your I797 acknowledgement from your AOS filing use that and your passport to travel until you get a ssc and state id, then travel in US with state ID you will most likely never show your passport or i797 papers in US.

In Arizona its hot hot hot.
