My husband and I were married on Feb 15, 2012. I would like to bring my husband to the united states to live ASAP because we are having our first baby. I was told so many things that I can bring my husband here if I file for a 1-130 and then CR1 visa. Can someone please help me because I do not want to be denied for filing the wrong forms? Also, when I file for the 1-130, what should the contents include? Thank you for your help. My husband is from the philippines and I am currently residing in the United States.

I personally think you should go with the CR1 visa.

Also in terms of getting him there 'asap' you have to realize that it will take around a year to get approved. I'm not sure of the times now but around 2 years ago it was a year. So I'd at the very least prepare to possibly spend the first bit with out him there. (which is utterly sad and I'm sorry for that). All of the best of luck to you.

Not that it matters but I'm wondering why this process wasn't started after your marriage, and the only reason it seems that you need him there soon is because of having a baby? Unless you guys didn't know where you wanted to be. It's the past now but I was merely wondering.

Besides going to the link CanadiaGirl gave you, stop in the regional sections for more information on the Philippines. Once you have the CR1 approved, there's the next part of the process which is country specific. The embassy interview, medical, and CFO are things you're going to want to be aware of when the time comes. Congrats on your new baby on the way.

Follow the guidelines as other VJ members have mentioned.

If you dont feel enough confident to organize the paper work yourself for immigration, then it is better to hire an attorney. It is worth to hire someone rather than making mistake.

Be very careful if you follow that advice in picking out your attorney. There are many attorneys that will take your money and screw things up for you. We see many stories about that here all the time. Normal cases are really not that hard to do yourself. Particularly if you read the guidelines here and follow the instructions with the forms. Any questions, and there is plenty of people here that have been through it to help answer those.

The reason why we did not apply after we got married was because I was suppose to stay there with my husband but we got pregnant and we decided it was best for me to go back to states to have the baby because it is very expensive to have baby there. If i file for the 1-130 petition now, then after that I can file for CR1 visa while he waits approval for the petition to go through. How long will the CR1 process take? Thank you

More expensive than in the Philippines? I've seen a lot of fil/am couples have the wife go to the Philippines to have a baby because its so much cheaper there!

yes it is. my sister had a baby there and she paid alot of money just so the baby can be discharged and if you are over 30 and its your first child, the women there are to have a c-section done there and its very expensive there to have that procedure done there.

A permanent resident is a green card holder. Born in the USA is a citizen.

As to the cost of a c-section in the USA, I've heard its 15 to 20 thousand dollars. My sister in law in the Philippines has had 2 c-sections, and the cost was a little over $1000 each time. A lot of money by Philippines standards, but significantly cheaper than one in the USA. If you're moving back the USA to give birth, you're not going to have insurance or get insurance that will cover you. Unless you intend to attempt to get the government to cover the costs of the c-section. If you can qualify for government medical assistance, you're going to have problems qualifying to bring your husband here.

Are you a US citizen? You say you were born and raised "here" but it is unclear whether you mean in the US or in the Philippines. As a permanent resident of the US it will take several years for your spouse to obtain an immigrant visa. As a citizen the process will take about a year. Do you currently have employment? Do you have someone willing to co-sponsor your spouse to come to the US?

Having a baby in the US is very expensive. You are looking at about $10,000 for prenatal care and delivery or about $30,000 or more if you need a C-section or have complications. Do you have health insurance to pay for this?
