Dear All

Thanks To Visa Journey Site Which Give Instant Information.

Now My Question That While I Have Arranged Marriage By my Parents As Muslim Culture , And It Is Not According To American Stander.

Is There Any Hitch As Uscis Previously Denied My AOS Because we did not prepare Aos packet according to USCIS Instructions and packet was incomplete & we were not living together , now I will have interview on 20th feb 2013 in New York City and received work permit approval last week , but not physically receive work authorization card ?

But still I am confused I have bona fied marriage and uscis last time putting very weak objection that your marriage is only immigration purpose , before first interview we had Nikkah on sept 2011 , we filled AOS but that time we did not live together due to Rukusti (Muslim culture ) (final ceremony) was not occurred, and we had interview and IO put red flag on my file , now we live together final ceremony had happened in my native country on June 2012 & completed all ceremonies.

Pls advise what is minimum cartria for approval , but this time I did filled all formalities according to USCIS instruction ,My case is very clear and clean no fraud. Please also advice which supportive papers should to take during interview .

If uscis will ask us Is marriage consummated , we ready give answer of unethical /ill moral question

there is proof of a legal marriage, where the two of you are legally married combined with the proof that you two are actually living together.

since you've finally got both things accomplished, is best to:

1. show that proof with the adjustment of status paperwork (did you do that, or no?) and

2. if no proof submitted prior to interview, bring all proof.

It's not that it's against muslim culture - it's solely that you have to be legally married and living together to qualify for an adjustment of status by the Rules of the USA - where ever they are codified.

In your particular instance, now that you have Rukusti, and proof of Rukusti, you have fulfilled those interpretations of the Rules of the USA, so that's a plus.

It's on you to prove up, to the fella handling the interview. If that proof was sent prior - hey - no worries ! If it wasn't - well - you have one singular chance to show the proof.

I can't tell you what the minimum cartria should be, alas - but suggest you bring all you have.

Arranged marriages may not be common, but USCIS is familiar with them. You still need to show a bonafide marriage, and a big part of that is living together. Other good prof is co-mingling of finances (joint bank account, lease together etc). It sounds like you were denied for two reasons: not filing in the papers correctly and doubts about bonafide marriage. There is no discrimination against you, but there is also no minimum critaria to get approved- the officer will look at the totallity of your case.

- What proof did you show the first time, and what extra do you have now?

- What visa are you on at this time?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Tum khe sae ho? :) Anyway, living apart at the time of marriage is a red flag, but if you have good reasoning why you live separate before marriage than it should not give you denial. I was living apart from my husband too, indeed, we're still living separate even though we already got married. We knew we have a good and valid reason not to live together before marriage (same as your case- due to religious background) and we had a good reason why we do not live together even now, and even at the time of interview. That should not be denying you. Maybe you just had less evidences as "bona fide" marriage. And no, there's no discrimination based on culture/religion. There are big groups of Muslims here (at least in my area where I live), and it is a freedom of choice what religious group one wants to belong to and each has their own restriction about living together prior to marriage, and how the actual wedding takes place (separately in each house). So, again, they should not deny on you on this basis. They like to see evidences as "joint bank account", "bill both of your names", photos, if any of you have a car then "joint car insurance", "joint health insurance". These you can do even if you guys are not living together. If you guys are renting an apartment then even if you live separately from your spouse, you still can sign the apartment lease contract so that both of your names on it! If you have some of these, then you should be fine!
