Ok before I ask for advice here is our background. We met online in 2009. In 2010 I moved down to Colombia to live with her. She was going through a divorce, they were already separated for some time. The divorce finally came through by the end of 2011, so we were planning on getting married in Colombia. During this period we find out she has miomas growing outside of her uterus and she needed surgery. She has public health insurance which sucks and the doctors were telling her she needs a hysterectomy. In the US with miomas 95% of the time does not require a hysterectomy, btw she is 28 and wants to have kids.

So I said to hell with it. I will come back to the US get a job and bring her up here to get better medical care. I got a great job with full medical coverage in the US which would cover her as well if we are married. HR said all they need is our marriage certificate to add her to my medical coverage.

I've put together the entire I-129F package, ready to go. I'm just stuck on whether I should even mention her medical condition.

1) With her medical condition will she be denied the K-1 visa during the medical exam? It is not a malignant type of cancer all she needs is a miomectomy or worse case a hysterectomy but we would rather do it in the US.

2) Can I petition with urgency due to her medical condition? Should I even mention this in the K-1 petition? I have a copy of the doctors report, I suppose I could translate it and include it with a letter explaining the situation.

3) Any recommendations for immigration lawyers?

Thanks

I don't think they will expedite your petition, her condition is not life threatening. It shouldn't really be an issue for the medical either. Why do you need an immigration lawyer?

Life threatening, not at this stage but she is in pain, swollen and bleeding more than usual. What I am worried about is if the miomas don't get treated in time then in advances to the point where she loses here uterus and who knows what else. So life threatening no, further complications, yes. Immigration lawyer to talk to a professional, maybe they know of a way to expedite this, I don't know.

I think she can apply for a visa to receive medical treatment in the US: that would probably be quicker than the K1 visa. Perhaps more experienced members can comment on this, but a lawyer can't really help speed things up.
