Cr1 interview refusal

hi all

long story short, I was interviewed today, and the officer think that our relationship is a shame for the purpose of entering the US as an immigrant, his reasons was saying that:

"You've met your wife only one time since you got married, and she traveled around the world, to meet you for the first time, and you already got married?!?!"

then he asked me to explain, and I did explain to him that we were both students, and we already had financial difficulties, but he were not convinced, then he issued a refusal that recommending revoking the visa for the uscis. (9 FAM 41.81 N6.5), (FAM 41.81 N2.2(3)), and become ineligible for a visa under section 212(a)(6)©(i).

So please, what to do?

Did you have all pictures/phone bills. I met my husband once. I believe about 50% relationships will be same where spouse meet once during wedding. You should fight back. Call senator or get a lawyer. Good Luck

yes I did show him the pictures, phone records, letters of bonafid of relationship from her mom, cousin and friends, but he didn't even look at them or barely did for some, but he emphasized on the fact that I was in Iraq, then he became aggressive , he didn't allow me to finish my answers, it was like if he made up his mind!!!

My husband is from Jordan as well, we met and married on our first visit, and had many other red flags. I am older than he is, we met on the internet, different religions. But, and this is a big but, after we were married, I visited him 4 times in 7 months, all extended visits, we missed each other and wanted to be together. My husband is now here in the US and we are happier than ever. You and your wife may know you a legitimate relationship, but the burden of proof is on you to show this to the CO. Marrying on the first visit, and having no subsequent visits in almost 2 years looks very suspicious to the consulate, you were married in June of 2011 and haven't seen each other since. What will happen now is your case will be sent back to USCIS with the intent to revoke or deny your petition, it will probably be a few months before you receive notice that they are reviewing your case, and you will have a chance to respond to that notice with more evidence of a bona fide marriage. You need to prepare for this and make sure you respond within the time given by USCIS. My recommendation is that you have your wife visit you, for an extended amount of time, you haven't seen each other in almost 2 years, face time is very important for both your marriage, and for USCIS, you married someone and you barely know her even after 2 years of marriage. I am sorry to hear of your denial, but you need to move on and get prepared for the next step, it will be an uphill battle. Best of luck. Keep us updated!!!

But I have to tell you that she was a student, I'm still a PhD student in Malaysia, so we were having some financial difficulties to be able to see each other and visit each other, later on she started to work, and she started to be able to help herself financially at that point, anyway, we wanted to visit each other after that, but then we thought why to waste the money...we are closer to get our interview (we were believing we will get the approval for sure), however, we both agreed on seeing each other next week in Jordan, but she can't come over for more than a week, since she have only a one week vacation every 6 months, so not sure if that will be useless or what, but we have to see each other as well, but my point here that we can do nothing about the period , she already asked her boss for more vacation time (paid/unpaid), but her boss rejected it!!

the visit won't be useless at all, I am glad you will get to see each other. It is tough when finances get in the way of being able to visit. The best thing you can do is just move on and prepare for the next step. I am truly sad for you both. Have fun next week, I really miss Jordan. Anyway, I'm really worried about the time we have to wait before we hear any new news, and is there really a real hope in this, or that it, its the end?

this is not the end at all, this happens more often than you think. I don;t know the exact timeline for when you will receive something from USCIS. Have your wife contact her senators office and see if the can give her some insight and ask them for assistance Start preparing now for the notice, gather more evidence, especially from her visit to Jordan with you next week. Fight it, you can and many people do and overcome it. It will just take time and effort. Good luck!!!!

Thank you for this hope, anyway, I found a new website posted by someone here in Visajourney, and you can check your status in it, however, the paper I was passed was a denial worksheet, but when I checked the website, its saying Administrative processing, at the same time they've return the passport back to me, so not sure what is this, is it something good, or bad, or its still under the same category of refusal, and had to be sent to USCIS and all of that stuff?

that is the dept of state site, If I were you I would have your wife call the dept of state today, this is the number 202-663-1225, press 1 then 0 for a human. When my husband was put in AP they returned his passport and requested it when AP was done. What exactly did the sheet you were given say? My husband was given a 221g for AP. Your wife really needs to call them and her US senators office as soon as possible, You should also have her come here to VJ and contact me, I can help. She is the US citizen she needs to do everything from the US. Let me know

Your best bet is to have your wife contact mimolicious who so graciously offered her assistance. But as she already warned you, its going to be a long uphill battle. Youve been married a long time and you need to prove its not for immigration benefits.

Youve been accused that its for benefits because you have no face time except for it seems like besides when you were married- is that correct? So you need to gather up your evidence about your entire relationship starting with that. How you met. How long was the visit when you were married. Im hoping it was a long visit. And then move on to why no other visits occurred since.

Financial difficulties is a valid reason. But and its a big but, it needs to be documented. A simple worksheet showing expenses out and money in will suffice. I dont know about the whole- She only gets one week off thing. And then she asked for more time off- even unpaid (?) that contradicts the financial hardship thing. If you truly ache to be with someone youd go for even one week because one week with them is better then no week with them...

I would urge you to think hard about what statement you put in your reasons for not getting together again and consider not saying things like 'why waste the money' because it could appear that money is the concern and not the marriage. When your wife contacts her representatives they have people on the staff that can assist her in preparing statements and evidence. But they wont write it for her. Its okay to say I had one week off and it was too large of an expense in a financially difficult time- but to say, I had the money and the time to travel but chose to meh, not the waste money and see him cause who cares?- is completely different.

Thank you very much for your replies, I really appreciate it, and it really means a lot to us especially in those times, I've already asked my wife to contact you, but she will do that when she come back from work :), this is the quote of our OF-194:

"Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the immigrating and nationality Act or regulations issued pursuant thereto. The following remarks apply in your case:

Your case is administratively closed. Consular officers apply a “reasonable person standard” when evaluating the bona fides of claimed spousal, fiancé€, and other relationship (9 FAM 42.43 N2.2 (3)). These facts (above as ascertained by consular officers would convince a reasonable person that the claimed relationship is a sham entered into solely for immigration purpose and to evade immigration laws (or otherwise invalid). Therefore, pursuant to 9 FAM 41.81 N6.5, the reviewing officer has decided that the petition should be returned to the U.S. citizenship and immigration services (USCIS) with the recommendation that it be revoked. When USCIS receives the returned petition, they will contact the petitioner, who will have an opportunity to rebut consular findings concerning this case. If USCIS revokes the petition, beneficiary will become ineligible for a VISA under section 212 (a)(6)©(i) (or other appropriate section) of the act. If USCIS reaffirms the petition, the petition will be returned to post for further processing."

Thank you capri for your reply as well, I do believe that they should dedicate a branch in this website to mock an interview with people, since those officers are hunting you down for specific words, none of us normal people know how to talk like attornies, and may state facts as it is in a wrong way, that could've been said in another way, give the same meaning, but have a positive impression rather than a negative one, my problem in my interview that it went all fine, I've answered everything honestly, and answered all of his question, until he saw that I was in Iraq doing my Bachelor's degree,at this time, he became very aggressive, stopped listening to me, interrupted me on every word I said, then started to accuse me!!
