Do I need to be in London to send & receive my passport when the visa is issued after extra AP?

Hi

I think I have two related but separate questions:

1. Do I have to physically be in London to get my visa after Administrative Processing? Can I just ask my fiance to send and receive my passport for K1 fiance visa to be issued, if she has my id? Or I have to attend to the embassy myself?

2. What are the chances of being asked for a second interview, considering that our interview went pretty well and all our documents were complete?

I've never heard of a second interview in London. Have you asked the embassy what procedures they have in place for a person whose UK visa expires and they have to leave the UK with their passport. How will your fiancé get your passport from your country to take to the Uk to courier to London and back to your country. Do you trust the mail service? Does she come from the US to do this? Does the UK have exit accounting to know when you leave the UK? Do they have enough manpower to deport you the day your visa expires. Are there laws that say as long as you are gone before 90 days overstay you don't face consequences? What are the consequences? Would you not be allowed to apply for a UK student visa until you waited a year? Do you need a visa to the UK again?

I don't know the answer, I'm just thinking out loud.

I would ask the embassy. Not the person who answers the phone, but ask for the email code to send and receive a response from an immigration officer. Maybe they have an easy answer that doesn't sound like the plot of a thriller movie.

I see. Thanks for your feedback. It's helpful. The only reason I haven't emailed the embassy yet is that I thought they might not like it that my visa is running out.

However, I asked the telephone people, whom you said I should ask for a code to contact the embassy directly, and they said you should be in the country, in case that they want to talk you again. Doing lots of research recently, I reliased it's kind of very unlikely to be asked to be seen again if your interview has gone very well, but there's always a bloody chance!

Email an actual immigration officer. The person in Scotland who answers the phone is not a good source of information. The issue of your UK visa is not a reason for the US to deny a US visa. Separate issues in my opinion except the logistics. Ask " I am in an unknown period of administrative processing for a K1 visa which I am told could last a year. If my UK student visa expires prior to to completion of the security checks, do you have a procedure for me to courier my passport to London from [country] receive my visa ?" You don't have to say how soon you expire. Maybe they will take your passport at your country's embassy and send it via diplomatic pouch to London. Maybe they will say your whole case will be transferred to your embassy for visa issue. If you don't like the answer, go with the fiancé plot.

As far as the courier and ID, they aren't generally that careful. I received my fiance's delivery from the embassy and the guy just handed it to me. Many others have reported similar or they just left it at the front desk at work...no ID required. So that part probably won't be hard if she has a credit card with your name on it or at least that's one of the IDs that used to be listed. Do you have a UK student ID or driver license?

I've known several who got out of AP in London in four weeks. How much time do you have? Maybe you will be one of the short ones.

Yup I have other id. Regarding my time, I have about a month, or two depending on UKBA, since I quit my uni very recently. It's been more than 2 weeks since the beginning of AP, but they didn't take my passport on the day of the interview. I have an "axis of evil" nationality!! So it could take anything from a few weeks to even 6 months and even more in extreme cases. Everything in our case is complete and convincing and we've been living together in London for almost a year. So I'm not worried about anything apart from the timing. Hopefully it won;t take long. I will deffo consider emailing to the embassy, but I doubt it that they can help me since AP generally takes as long as it takes.

No they can't speed it up but they could tell you what happens if you have to leave the UK.
