i sent the AOS package 3 weeks before my 90 days in the USA but today my visa expires. should i be concern about it? does it mean that i'm now ilegal in the USA? i have the biometrics appointment until March.

Please advice

Did you get married within the 90 days you got your visa? If you did, then you shouldn't worry.

Yes, we got married within the 90 days but i'm alittle worry because the visa will expire today (90th day).

Don't worry because you're not considered an illegal immigrant because your visa has expired. USCIS is aware that it is not possible to adjust status within 90 days. But if you want to travel outside US before AOS interview, you just apply for a advanced parole, form I-131, and you will be fine. Good luck

I'm assuming you entered on a K1 visa. Technically the K1 visa expires the day you use it to enter the country - it is a one time use visa. Your 1-94 is then valid for 90 days. ( I take it the i-94 expired) If you got married before the 90 days is up and then applied for AOS - you are not here illegally! Your NOA1 from the AOS provides proof of legal presence until you receive your EAD/AP card.

Unfortunately, with the K1 visa, you are in kind of a limbo from the time you apply for AOS until you get the EAD. NO need to worry - you are not illegal - just in ID limbo!!
