Barry - so glad your interview is set!

You can email the consulate something to this effect:

(Date)

From: (Your name, address, phone, SS number)

To: (Name and address of consulate)

RE: (name and vital data of your fiancé, case number, fiance birthdate

Dear

It is my understanding that pursuant to 9FAM 41.81 N3.1 (Period of validity), the consulate can extend the approval notice for another 4 months, if my fiancé and I remain legally free to marry and continue to plan to marry after my fiancé enters the United States.

Therefore, please be aware:

• I and my fiancé continue to be legally single and free to marry.

• I and my fiancé love each other and plan to marry after his/her entrance in to the United States.

• If my I-797 approval notice has expired by the time of my fiancé’s interview,

I sincerely request that you extend the approval notice so that my fiancé, (name of fiancé) may receive the K-1 visa.

The Consular Staff can extend the validity of the NOA-2. I would take a proactive approach and contact the Consular Section to ensure the NOA-2 is extended ASAP. There is no need for the NVC letter in the continuing process.

Edit to add: With respect to Kitkat, such a formal request is not necesary, unless the Embassy is a hard azz location. A simple phone call should suffice.

My Noa2 will expire before my interview. Is there any action required by me? Also I never received my NVC letter. Do I need it? I already have an interview date. Thanks.

The consulate has the ability to extend automatically for another 4 mos the expiration of an NOA2. Look in the forms section their is a sample form requesting an extension if you do trust the consulate to do it. I am certain however that they are aware of the dates since you already have a scheduled interview

If your interview has been scheduled you have nothing to be concerned about. Your case is proceding as it should and the consulate will extend the approval of the petition on their own.
