My fiance's interview date is creeping up and I'm getting really nervous! I feel like I don't know what I'm doing at this point. My dad is our co sponsor, and of course he wants to keep his original documents, so would it be ok if I sent copies of his 2012 W2s and copies of his paystubs? Also, is it really necessary to have an employment letter? I was going to attach a letter stating that I did not make enough to file taxes this year, so what should I say on it? Sorry for all the questions, this is keeping me up tonight!

The copy of the W-2 and paystubs should be fine(from my experience), however the original letter should be needed. As they need to know you are not just making up something. You can ask someone from the London embassy for more details. Good Luck!

The AOS packet instructions directly state that they only need copies of the W-2 or 1040's and the paystubs. Originals are not required.

W2, or tax returs and paystubs can be copies, my now husband sent them over by email and I printed them. But the I-134 must be original and anything else with your/your co-sponsor signature must be original!

I had copies of my dad's (co-sponsor) W2s, 3 years of tax returns, a bank statement, and a few pay stubs. I had an original letter from his employer on letter head and also the original I-134 (both from my dad and myself). Also I had a copy of my dads birth certificate to prove he's a US citizen.

My husband was only asked for the pay stubs and they were fine with just copies.

I had my interview Monday and although we didn't need a co-sponsor all I handed over were copies of my finance's tax transcripts and his W-2s. The affidavit of support was the original though. I didnt even have an employment letter.

This is LONDON information (and not for anybody else because I haven't studied other consulates.)

For the I-134, London doesn't care why you didn't file taxes. They don't even require a tax return from a sponsor. They basically want a sponsor and if you can't do it, then your Dad's I-134 will be fine. They will take any valid proof of his income. Two forms of proof is suggested but usually one form is all they keep and file.

Pick two from the list. ANY two--

  1. Tax return + W2 or 1099 (photocopies) OR Tax transcript (I'd send original because they are so easy to get another for your adjustment of status)
  2. Pay stubs (photocopies)
  3. Letter from employer (original on letterhead)
  4. Pension statement (photocopies)
  5. Social Security statement (photocopies)
  6. Financial statements showing investment assets if going that route. (bank, Edward Jones, Charles Scwaab, brokers)
  7. Anything else that shows income
