Hi Everyone.

I am applying for my AP document late as I was given poor advice when filing for AOS back in October. I have already received my EAD back in December 2012. There is no emergency to return home - I am just worried about missing a friends wedding in July 2012 if my AOS is still processing (hopefully it's not...this is just taking precaution!).

I know that I need to fill out the I-131 and plan to do a cover letter. And I know that sending in a copy of my NOA1 from my AOS is necessary to show that I have already filed. I know that it's free to file based on my pending AOS. Do I need anything else? 2 more passport sized pictures or a copy of my expired I-94?

Appreciate the help!

Thanks!

Stacy

The NOA from filing the I-485, 2 passport photos, an official photo identity document(such as bio page of passport or drivers license/state ID), USCIS document showing current status in the US and form G-1145 if you want e-notification of them receiving your application. See the I-131 instructions: http://www.uscis.gov/files/form/i-131instr.pdf

Not sure what USCIS document showing current status in the US you are referring to? Is that a copy of my expired I-94?

That is what the instructions say. Most people use a copy of their K-1 visa, but they typically send in the I-485, I-765 and I-131 at the same time. I think in your case a copy of your EAD would work too.

That's crazy, why would you apply for a AP if it's not even guaranteed? Jesus, USCIS man, can' deal anymore. I got so excited to read that it only took 2 weeks for you to receive it but their comment about no guarantee, what does that mean? I need to apply for my AP too late because this AOS process is taking forever, filed in May 2nd last year.

Fingers crossed for all us that we'll get our GC soon :)

Well, a visa doesn't guarantee you entry to the U.S. either; it's up to the officer. That's what it basically means. Most people shouldn't have a problem. But there are some things that will cause them to deny you entry.
