Me and my wife (a US citizen) got married a month back and are filing for my adjustment of status. We are both in college, she lives with her parents in Connecticut whereas I live in Florida renting a house with other roomates. We truly love each other and we will be moving in our own place in Florida after she graduates in May 2014. We see each other during breaks and she will be spending the summer here with me.

So far the things we have to prove our bona fide marriage: Our joint bank account, joint car ownership and auto insurance, our wedding certificate from court in connecticut, our wedding certificate from the mosque (as required by our religious faith), our pictures from wedding & honeymoon in key west, she has also changed her last name to my last name on her SSN and her drivers license.

What are the things we should consider while filing for my AOS ( I am a student on F1 visa) since we are not living together till May 2014 and I heard it will be really difficult to prove our marriage to the USCIS if we are not living together. Any suggestions, advice, help will be much appreciated.

You have to show a legitimate reason why you guys are not living together, and why you guys are not going to be able to live together until 2014 May. I wasn't living with my husband prior to marriage, or even now, after being married for nearly 6 months, but I brought with me proof of where my husband is working and that his income is much indeed needed for us to be able to survive, so he cannot leave his work to live with me, while I also had proof that I am registered full time, and even after I'll adjust my status, I will want to finish my school, hence will remain as a full time student at my university which is not where my husband is working, hence we cannot live together, and are not living together. Either way, if you have enough evidence they won't even look at these proofs. We had many good evidences of bona fide marriage, so besides our photo album, the IO did not want to see anything else, (even though I had my backpack full of all #######) and got approved on the spot in like 5 minutes. Good luck!

Well then I guess showing that she is a full time student at school in Connecticut till she graduates in May 2014 and me a full time student in Florida counts as a legitimate reason, right? I mean thats the sole reason why we cant live together

Thank you so much for your response!! I was getting a bit nervous because someone had told me that my AOS would be jeopardized if I wasn't living with my husband ... but it is only because he is doing his PhD in Utah and I will be joining him once I graduate from my MA program in California in May.

Seems like the recurrent theme is that as long as it is real and you have solid proof then you will be fine :)

Pre AOS

September 2011: Comes to the US for a year study abroad
August 2013: Returns to the US (went back to the UK to finish my undergraduate in 2012) and starts master's degree program
December 2014: Get married to my now husband after being together for 6 years :)
AOS
January 2015: Starts working on application
02/10/15: I-130, I-485, I-131, I-765 received by lockbox
02/23/15: AOS returned because they couldn't find my I-485 check ... bloody ********
02/24/15: AOS mailed back out
02/27/15: AOS delivered to Chicago Lockbox
03/06/15: Case accepted and routed to USCIS NBC (National Benefits Center) for processing
03/09/15: Checks cashed by USCIS
03/14/15: Hard copies received in the mail for NOA1 for I-485, I-131 & I-765 (waiting on I-130)
03/21/15: Received notice for biometrics, scheduled April 3rd
3/23/15: Received RFE :(
04/03/15: Went and did my fingerprints
04/11/15: Supporting evidence for RFE for Initial Evidence received by USCIS
04/20/15: Case status online for I-485 updated to 'ready to schedule interview' :)
5/14/15: EAD approved
5/16/15: Received notice for interview, scheduled for July 7th! (moved from June 17th)
5/21/15: Received EAD
7/7/15: Had interview
9/2/15: Received my green card! :)
