FREAK out when I read these horror stories about folks being denied for one reason or another. I know in most cases, they are probably not legit, don’t have ducks in a row, etc...but still it makes me nervous as HELL :innocent: I still have a really hard time believing people would go through this whole process, for any other reason than love. just my rant. I am on a roller coaster with this for the past few weeks. I am not reading any more "denied" forums... they get me every single time LOL B-)

So, I guess I really do have one question – when / if you get denied ( god forbid) can you appeal that decision? Ok, now I’m thinking WAYYYY to far into this………………..

Yes you can. However, it is often cheaper and quicker just to file again.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

don't get yourself distracted reading numerous stories, every case varies and depends how much evidences you have aggregated to show the CO, take my advice get yourself busy doing other things, rather than reading more stories of Denial, you will be like what if this happens to me don't ever assume this might occur to you as well, when i had my Past petition, i used to be like you always used to think negative, just believe in Allah think positive and if your relationship is strong enough to convince the CO, inshallah you will get it, don't stress yourself out just let your hair down,i wish you best of luck for your successful interview.

You should not worried much. Like Mohsin786 said above, every case is different and as long as your relationship is legit you should have no problem. This process is very lengthy so you just have to sit back and relax waiting the time to come. I just applied for my petition as well. At first, I was a really concerned and impatient but I told myself just to come down and take one day at a time.

Yes, Sir :) everything seems great. today is our 4 month Immigration Journey Anniversary. hopefully most of the "waiting" is over :):rofl:

There are far more stories of successful completed journey's than there are of those denied. And usually the ones that are denied are quite comical: "This is my third k1 visa application in 18 months......." "I met my soulmate, fiancé online 2 weeks ago and we want to get married, but have never met before and we are 40 years age difference....."; "My fiance is in prison for felony xxxx, and we have never met before".......

These stories are the common denials. The rest of us put up with some pressured interviews, long waits, a RFE or so, but not denials. :)

The "denied" forums are just as important as they approved ones. Learn what they did wrong and don't do that. Failure is learning also.

legitimate couples and visas get denied every day, mostly for being ill-prepared or forgetting something. It is good to look at why people here are denied, especially from your own country, so you don't make similar mistakes. Love alone or God doesn't get you through this process. Reading, understanding and following directions, filling out forms correctly, sending in the correct documents, having supporting evidence, among many other things gets you through the process. Just because someone is denied, does not mean they do not have a legitimate relationship. Good luck, and try not to obsess over denials too much, but do read them so you can learn from them.

I would imagine that the process is easier for those who are not doing it for love........ Love was the thing that kept me impatient throughout the whole process.. From start to finish.

If the CO refuses the visa your case would get returned to USCIS.

CSC does not reaffirm K1's but VSC does sometimes reaffirm.

CSC leaves the case sitting in storage until the validity is expired. They will tell you that you can refile.

Appeals are costly and take a long time.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Funny, I think the same way. Not being pessimistic but realistic! Now it's been some long , I am trying to just be optimistic! :rofl:

So true, I try to focus on these months are merely a portion of our life together..........awww that was so sweet. lol. (omg am i losing it ? I think I just made a statement and then commented on my own statemetn - lol ) :blink:

My husband and I defied ALL odds!

Being that:

  • He is 15 years younger
  • I am in my 40's
  • He is hearing
  • I am Deaf
  • He is Sunni Muslim and I am a Jesus Following Muslim
  • He is Algerian Arab
  • He is fierce, protective, and suspicious of EVERYTHING (alhumdillilah)
  • I am calm, easy-going, relaxed, humbled.
  • I am the money-maker
  • He is a college student now
  • I am a career woman... working as a teacher
  • He has zero income (Alhumdillilah)
  • Me Caucasian American
  • We met only 4 months then got married
  • Flew through the process with NO problems other than an intensive grueling interview on his part
  • I'm an American Sign Language Speaker
  • He is a French-Arab speaker

In spite of all these odds, we made it through. I was VERY very meticulous with ALL my applications. I spent 2 months pouring and triple checking for anything amiss. I made my own CHECKLIST and checked it off OFTEN to make sure I did not overlook anything.

Even for some people who were meticulous with their applications get denied. Just pray you have a wise CO! It's just the Path that Allah has chosen for you.
