Hello All,

Processing time for our K-1 Visa is stretching a little longer than expected, and my fiancee has already finished up her

job and everything else in Japan, so we were thinking of having her stay here for about 2 months while waiting for our approval and

notice for her embassy interview in Tokyo.

I checked with USCIS and was told that her being here itself would not conflict with the K-1 process.

The trick is we don't know when the interview will be, and obviously she cannot enter on a 1-way ticket(cost a fortune anyway).

Does anyone know if her buying a round-trip ticket, and not getting on the return flight would cause a problem as long

as she does not overstay the 90 day visa free limit for Japan?

I understand this is a fairly odd question, but any help is greatly appreciated.

Too little info. Is your fiancee originally from Japan/Japanese citizen? When is your NOA1 date?

Right now, petitions are teking longer to be adjudicated, and the process overseas varies by country. Waiting for an available time slot for medical, gathering papers, getting an interview date. Too many factors to account for and to just hope it'll be a smooth ride.

She can visit you for sure; as long as the VWP/ESTA (or tourist visa) is valid. Visiting during the process in fine. It's just a matter of her being let into the US with basically no ties to home county/Japan. Personally, I'd have a plan B in mind in case she is questioned and turned away. A CBP officer might just say "enjoy your stay" and on she goes.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days
