Hello everyone, So after all the struggle we went through the paperwork and RFE's we finally received the interview for my husband! is next month and I'm a total nervous wreck, I'm unemployed and we both stay with my mom. I don't have any mortgage, any joint accounts or anything with my hubby! only pictures of us together, my passport stamp when I traveled to England to visit his family and some mail his mom sends us. ALso to make things worse he got a misdemeanor 2 weeks ago, the cops set him up got a ''furnishing alcohol to a minor''... they were undercover cops and my husband is always nice, he never says no.. ugh...

What other things can I bring to the interview? any suggestions? do you guys think that hes going to be denied because of the misdemeanor?

get a lawyer

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

I just google it and found one site that says it is not a CIMT.

So, just do a free consult at immigrate2us.net

On Wed at 1200 online....that is 11am Illinois time. I do not know where you are

But you can ask the immigration lawyer or you can post a question come back later for the answers

Adjustment of Status interview 1 week before crimal court...what should I do? Do I have to fix the application to show the arrest in front of the CO?

This is not a crime of moral turpitude, don't try to scare her. Your husbands background check has probably been completed already and it hadn't happened at the time of filling out the I-485 so they likely won't even know. The problem is that they usually ask during the interview "Have you ever committed a crime?". Different officers ask different questions from the I-485, however, it is highly likely they will ask that. You husband needs to tell them, and should consult a lawyer to find out what information/documents he will need to bring to the interview as evidence. If he lies it will likely come up in further stages like "removal of conditions" or naturalization. If they find out later that he lied, he will likely have his greencard taken away and deported. Anyway, you should consult a lawyer about what to do. I think it's unlikely that his AOS be denied because of this offense. Lots of people who adjust status have charges like these that aren't major offenses.

You should also kick him in the nuts for doing something so stupid and inform him that "entrapment" basically doesn't exist in the USA legal system.
