Congressman seeks to overturn Citizens United

WASHINGTON — A Democratic Minnesota congressman is introducing a constitutional amendment designed to overturn the Supreme Court's decision in the Citizens United case that lifted many restrictions on corporate spending in political elections.

Rep. Rick Nolan unveiled the proposal on Monday along with members of Move to Amend, a grassroots coalition that has been seeking support on the local level in communities for the amendment. They say political campaign spending should not be a form of speech protected under the First Amendment.

Supporters of the Citizens United decision say it upholds the First Amendment guarantee of free speech.

Section 1. [Artificial Entities Such as Corporations Do Not Have Constitutional Rights]

The rights protected by the Constitution of the United States are the rights of natural persons only.

Artificial entities established by the laws of any State, the United States, or any foreign state shall have no rights under this Constitution and are subject to regulation by the People, through Federal, State, or local law.

The privileges of artificial entities shall be determined by the People, through Federal, State, or local law, and shall not be construed to be inherent or inalienable.

Section 2. [Money is Not Free Speech]

Federal, State, and local government shall regulate, limit, or prohibit contributions and expenditures, including a candidate's own contributions and expenditures, to ensure that all citizens, regardless of their economic status, have access to the political process, and that no person gains, as a result of their money, substantially more access or ability to influence in any way the election of any candidate for public office or any ballot measure.

Federal, State, and local government shall require that any permissible contributions and expenditures be publicly disclosed.

The judiciary shall not construe the spending of money to influence elections to be speech under the First Amendment.

It won't just affect the corporations.

All organizations will be affected. You must be a living and breathing human to have rights under our constitution in the future under this amendment. The hope is to curtail how much access special interests have over politics and return more say to people.

It removes the sole right of the people to assemble and act collectively. As written, the Feds, the States, or local governments could restrict, ban, or regulate any organization of its choosing, including political parties, unions, and fraternal organizations. One party rule is the goal of this legislation, obviously. Now we know why Democrats want to take away all the guns.

I'm sure whatever the text is it will affect labor too.

If labor was smart, they would dump the Democrats and form their own party. Union membership, especially among the trade unions, would soar, when they no longer have to support policies that are self-destructive, such as immigration issues, or all the sissy issues liberals support that turn the stomach of folks like Kip, the poster child for labor in America.

Is that truly the view the right is telling people to believe? Gonna make Amerika into a one party state! If we disallow organizations co-opting our elections with money we'll loose our rights. More likely the completely unrepresented middle class will get heard again.

I have no idea what the right is telling people about this. I am still waiting to see what AARP and the American Legion might have to say about it.

Funny I didn't know AARP and the American Legion were so afraid of the Republican party not being able to get votes and disappearing.

The plot thickens.

People that favor gun control need this amendment to limit the NRA. The NRA like any organization that values freedom, is strongly against limiting free speech.

Generally people either support the constitution or try to p*ss all over it in any way they can. Not surprisingly the same people that want to controlfirearms ownership by banning arbitrary cosmetic features of firearms, want speech control, and elimination of the 4th amendment
