Hi All,

As We have started filling out form I-864, there are few question regarding sponsorship and income which are bit confusing. Any help on below question would be greatly appreciated.

Here is my case. I on H1-B since 2008 and I got married to my wife who is USC in Nov-2012. She moved to another state with me and we have been living together since then. She was employed in 2011 and 2012 but quit the job in October before the move.

1) Q23 - My current individual annual income is : ?

(Is it reasonable to put ZERO in this case since my wife is currently unemployed but looking for a job?)

2) Q24 B - Income you are using from any other person who was counted in your household size, including, certain conditions, the intending immigrant.

( My income is well above poverty line therefore can I include my income here since we have been living together? however it's been only 2-3 months.)

3) Q25 - Federal income TAX return info :

( If I qualify as Intending immigrant sponsor, then does it make sense for me to include my federal tax return along with my wife's tax returns ?)

4) Q26 - Your Assets / Q28 - Assets of Immigrant

( For safety purpose we are planning to show saving account amounts. But we have combine/joined bank account. Should we write saving amount under Q26 or Q28 ? )

1) It is reasonable to put zero if you plan to meet the poverty guidlines by other means (ie. your assets, which would have to be 5x the minimum 125% poverty guidlines based on family size)

2) You can probably use your income, but do you expect to lose your income as a result of moving to the United States? Do you have another job lined up? This may invalidate your income and you may have to use your joint assets to meet the poverty guidlines (bank accounts, etc).

3) Do you have a federal tax return if you do not yet work in the United States?

4) Lets wait to hear what the more experienced have to say about this. I would include it under one but not the other. Probably under your assets (Q26)

Yes. 0 is the correct answer since she is currently unemployed.

2) Q24 B - Income you are using from any other person who was counted in your household size, including, certain conditions, the intending immigrant.

You can list your income on 24b. You must include proof of the income continuing from the same source even after you become a permanent resident.

3) Q25 - Federal income TAX return info :

( If I qualify as Intending immigrant sponsor, then does it make sense for me to include my federal tax return along with my wife's tax returns ?)

You can include your most recent too. Your 2012 taxes should be filed jointly anyway or married filing separately since you married in 2012, if you have those done already.

4) Q26 - Your Assets / Q28 - Assets of Immigrant

( For safety purpose we are planning to show saving account amounts. But we have combine/joined bank account. Should we write saving amount under Q26 or Q28 ? )

Just list them under #26 and show proof of the assets. The proof will show it is a jointly owned account/savings. Assets are used at 3 times the amount for a spouse, not 5.

Thanks Jay-Kay and waiting234 for your response. I am much more clear now. Just one more thing , I read somewhere stating that in order to be Intending immigrant sponsor me and my wife should be staying together at least for a six month, is it true ?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
