Can any tell me after reading the information i am providing below that if i an still eligible for US immigration under CSPA.

Application filled by my aunt in US for my mother under F4 category .

Our priority date is April 30, 2001.

my DOB is oct 28 1988.

our DS 230 was completed on April 08 2011. with the email mentioned below.

The NVC has received the information you submitted and placed it in your case file. You will be

contacted when your petition is sent to the U.S. Embassy or Consulate for further processing.

Did you get a letter from the NVC indicating that visa application for you has become available for further processing? It is my understanding that the DS-230 form is to be filed only after the initial completion of the process (paying for the Affidavit of Support fee). If your DS-230 form was prematurely submitted to the NVC, it will stay in your file until such time a visa number becomes available.

You should check the visa bulletin; if you are in countries other than Mexico or the Philippines, your petition's priority date just because available (http://www.travel.state.gov/visa/bulletin/bulletin_5953.html). If you are from Mexico or Philippines, the priority date is not available yet.

With regards to your age when your visa becomes available, I suggest you stay unmarried to retain your "child status" when your mom's petition becomes available. Under the CSPA laws, you retain the same priority date based on your original application (as a derivative beneficiary of the initial petition). This means when your mom petitions you under the F2B category, you still have April 2001 as your priority date.

P.S. I am not a lawyer; I'm just doing a lot of research at the moment as it relates to CSPA because my sister is currently processing her visa and awaiting interview.

Hi im new in this forum...

I'd like to ask you 5angels2gether

I had a somewhat similar question with the guy named cgxsdream

About the petition of my aunt to my dad, at this moment my dad is a US citizen, I wanted to ask because when they filled up a DS-230 form way back 2004 I was listed in the persons who will follow to the US at a later date.

My Dob is 22july 1980

My dads PD is jun1981

My parents had their visa way back 2005 and left for US at the same year, I wanted to ask if there is a way we could find out if

"I was really included in my parents petition as a derivative beneficiary? "

Its been a long time and my parents and aunt couldn't remember details and copy of all forms they submitted.

" I am desperate to know if there is a CHANCE I was a beneficiary and if there is something we could do to claim something, if there is, or should they made a separate application for their children that time so we may benefit even if We Aged Out?

Then you mentioned to (him ) cgxsdream might or could retain his original priority date under CSPA..

Im confused about how and when to qualified as a derivative family member?

Since they are living in US they applied an f2B petition for me and i was wondering if it is possible for me to retain my dad's priority date ?
