So many questions about filing the I-129F

Hello Everyone

I am so happy that VJ exists because I have SO many questions and know that I can get answers from the experiences you have/are going through. We are just starting out on this journey and getting ready to put together our I-129F so that we can send it out and join all of you in what I understand is an exciting but a bit stressful venture. We are ready to do what needs to be done so that we can continue our life together in California.

I really am feeling a little stupid asking all these questions but I did try looking up answers and didn’t get the answers I needed, so I am hoping that I can get them here from some of you that have gone through this. I just want this packet to be perfect so that it goes straight through without any problems. I think off the bat we have red flags because of our age difference and the fact that he was denied a student visa about 9 months ago because of the guarantee. Any information or advice will be greatly valued.

OK, here go all the questions:

Birth Certificate – I read that I should make a copy of the front and back of it but my BC has nothing on the back so do I need to include a copy of the back if it is blank? Also should I include my fiancé BC too?

Passport – Is it a good idea to include a copy of my fiancé passport?

Divorce Degree – Do I have to make a copy of the entire divorce agreement or just the first page and the back page that has the judge’s signature on it?

G-325A – I read that we are supposed to sign and date this form but I don’t see where there is anything that says signature. I see a place that says print so is this where we sign or can we type our names and write in the date?

I-129F – I am confused on where to send the packet. I live in California so do I send it to the Dallas lockbox and if so do I send USPS P O Box address or can I send it to the express / carrier delivery address? I have seen something about the California Service Center and not sure if maybe this is where I am supposed to send it because I don’t live in Texas where the Dallas lockbox is located.

Proof of Relationship – I am worried because we communicate 90% of the time through Yahoo messenger / video chat, we use this because it is so easy and I get it on my phone and I pad so where ever we are we can communicate. We don’t have too much in the way of phone bills since we talk on chat and only use the phones to call and let it ring once to let the other know we are on line. As for texts we have some, we have a couple e-mails and some facebook chats. We have enough of other stuff like things we have sent to each other and the receipts from the post office. Is this going to be a problem for us? If so are there any suggestions on what we can do?

I-134 – Can I use my family support that I am getting from my divorce agreement if it is a substantial amount and way over the amount needed for the 125% poverty level? I do not work and have not worked for 14 years because I have been home raising my daughter. If I can use the family support where do I put the amount because I don’t see any where that stats something like that. I do see a place if you’re self-employed.

On #7 of the form would I write unemployed?

On # 11 I am not sure what this is and what I am supposed to write here. I thought that the 1-134 form is to make sure that you intend to support your fiancé, so do I check intend and the say I will support him with any and all monies needed to live here in the US? So confused!!!!

What am I supposed to write after – as amended in the blue area under – Oath or Affirmation of Sponsor?

Signing / dating papers – where I have to sign and date anything such as cover letter, letter of intent and declaration of how we met etc…. can I just put the date next to the signature on the bottom of the page and write it in instead of typing it in? because I need to send these papers to my fiancé and have him sign and date but I want to send them to him now and have him sign and date and then return but it takes time and I want to date it the same as he dates it. Maybe there is an easier way to do this if so please let me know.

I had read that we should sign all papers in blue ink, is this true?

Ok now that I have written a novel and you’re falling asleep I hope that there is someone out there that can help me out with these questions. I hope I don’t look too stupid because I really am not!!!!

I highly recommend reading the guides as almost all of these are answered in there. But here's my shot at the ones I can answer from my experience.

1. I included a blank copy of the back just in case. So basically a blank sheet of paper with a sticky note. Who knows.

2. Foreign BC is not required at this stage.

3. Passport is not required, but if you have stamps from visits it is a good idea to include those and the identifying page.

4. No advice on divorce decree.

5. Send it to Dallas. It gets rerouted by Dallas to either California or Vermont.

6. Send everything you've got. Boarding passes and passport stamps are primary evidence, then pictures together. Everything else is secondary evidence. My fiance and I use FaceTime almost exclusively, but we sent a few emails and iMessage logs and Facebook screenshots just incase in additions to our passport stamps, respective visas (I studied in the UK and he studied here which is how we met), and a bunch of pictures.

7. No advice here.

8. The I-134 isn't submitted until you're at the interview stage...so no worries yet.

9. We wrote dates in. In BLACK ink, which is the recommended. Not blue.

Hey, just to add. I included scans of every page of my passport as did my fiance, inc. the I.D bit and the parts which showed I was admitted to the U.S and on what dates. If either of you have something in your passport (you being admitted to Turkey or him to the U.S), it might help to prove you've met in person in the last 2 years. I scanned our boarding passes too.

I signed my stuff in blue ink. I'd read about some people being RFE'd using black as they think it might have been photocopied.

Yes make a copy of the back if even nothing is there(i.e. even if blank page)

Yes a copy of ENTIRE divorce agreement/decree.

Yes there is a 'block' but it's not numbered. It is the third (3rd) block from the bottom of the G-325A to the RIGHT of "naturalization", "Status as PR" and "Other (specify)". Your petition must have two(2) G-325As signed & dated by petitioner and beneficiary.

Dallas Lockbox Address. You will find this on the I-129F instructions.

Please take another look at the VJ k-1 guide. It provides several examples of such evidence you should send. Send as many of such evidence as you can. It doesn't have to be all of them , but as many as possible.

I dont think you need I-134 form at the petition stage. At least I didn't see it in the instructions. Maybe a more experienced member with expertise on I-134 will chime in.

My wife is at home raising our daughter the last two years. So we wrote: "Stay-at-home-mom" in the first block to 'present time'. Then on the other blocks we listed her past employment in chronological order.

Again I don't think you need to submit this at the petition stage. Please revisit the guides above.

Check the guides cover sheet, sample 'intent' and other documents in the guides. But I see this as format style by individual actually. We typed the dates at the top right hand corner. Then at the bottom, we made a space for 'print name'. Then made a signature block and date...i.e.

Name: John Doe

Signature:______________________ Date:____________

Most government forms ask you to "print clearly and sign in black ink". We signed in BLACK INK, not blue. So you sign your I-129F and other forms in black ink. Unless specifically instructs to sign in blue.

Best advice...dont even worry about form I-134 yet. The rest of your questions were answered here and are in the guides. Also dont forget to look at example forms, they helped me alot too.

Haha no real need for your whole passport if you have ur BC tho :D

But yes I sent the back of my blank certificate as well :) Also no need for foreign fiances passport unless of course like you said its the passport stamps saying he entered the us if he did :)

I will go ahead and answer the questions about the I-134 since you will need it later anyway.

You can use child support. List it as income. You will need to provide proof of the amount and that you receive it. So, you need to include a copy of the court order and show check stubs or bank statements to show the amounts you are actually receiving each month.

Nothing. Ignore it and leave it blank. It is just a mistake/glitch in the form. Just sign and date it where it asks.

Wow I just love love love (L) this site, everyone is so nice and helpful.

Cassie - i am such a spaz :wacko: when it comes to this because we want to be together ASAP i will file in March(which looks like maybe by Christmas if all goes well) Hahahahah glad your man is from Turkey so we can exchange how the process is going for us.

Birth Certificate – I read that I should make a copy of the front and back of it but my BC has nothing on the back so do I need to include a copy of the back if it is blank? Also should I include my fiancé BC too?

Yes and No, your fiance needs theirs at the interview.

Passport – Is it a good idea to include a copy of my fiancé passport? Not needed.

Divorce Degree – Do I have to make a copy of the entire divorce agreement or just the first page and the back page that has the judge’s signature on it?

Yes, all of it.

G-325A – I read that we are supposed to sign and date this form but I don’t see where there is anything that says signature. I see a place that says print so is this where we sign or can we type our names and write in the date?

Sign there.

I-129F – I am confused on where to send the packet. I live in California so do I send it to the Dallas lockbox and if so do I send USPS P O Box address or can I send it to the express / carrier delivery address? I have seen something about the California Service Center and not sure if maybe this is where I am supposed to send it because I don’t live in Texas where the Dallas lockbox is located.

Dallas, per the instructions. Always follow the instructions.

Proof of Relationship – I am worried because we communicate 90% of the time through Yahoo messenger / video chat, we use this because it is so easy and I get it on my phone and I pad so where ever we are we can communicate. We don’t have too much in the way of phone bills since we talk on chat and only use the phones to call and let it ring once to let the other know we are on line. As for texts we have some, we have a couple e-mails and some facebook chats. We have enough of other stuff like things we have sent to each other and the receipts from the post office. Is this going to be a problem for us? If so are there any suggestions on what we can do?

Well, then begin to purposefully generate different evidences. You need to prove to a trained but total stranger, the Embassy CO, that you have a legitimate relationship. All this is only needed for the interview.

I-134 – Can I use my family support that I am getting from my divorce agreement if it is a substantial amount and way over the amount needed for the 125% poverty level? I do not work and have not worked for 14 years because I have been home raising my daughter. If I can use the family support where do I put the amount because I don’t see any where that stats something like that. I do see a place if you’re self-employed.

On # 11 I am not sure what this is and what I am supposed to write here. I thought that the 1-134 form is to make sure that you intend to support your fiancé, so do I check intend and the say I will support him with any and all monies needed to live here in the US? So confused!!!!

What am I supposed to write after – as amended in the blue area under – Oath or Affirmation of Sponsor?

Signing / dating papers – where I have to sign and date anything such as cover letter, letter of intent and declaration of how we met etc…. can I just put the date next to the signature on the bottom of the page and write it in instead of typing it in? because I need to send these papers to my fiancé and have him sign and date but I want to send them to him now and have him sign and date and then return but it takes time and I want to date it the same as he dates it. Maybe there is an easier way to do this if so please let me know.

Yes but it's OK if the dates are all not the same. They can't be.

I had read that we should sign all papers in blue ink, is this true? Black works too, pink not so good.
